    This was posted on thisismoney about a firm of solicitors involved with claims management here


    The Legal Complaints Service (LCS) exists to pay out compensation for distress and inconvenience, but the amounts are small and, as the solicitors must pay the fee, there is no guarantee they will be able to pay it out. The SRA has a Compensation Fund, and a specific Claims Management Unit within this. However, you could only be compensated from this if you had approached CCLS directly and had not been introduced to them via an intermediary like *****. It is believed the vast majority of CCLS client files came via ******.
    If CCLS is holding your money, the SRA will contact you in the near future to ask how you would like it returned to you.
    What do I do in the meantime?
    Continue to watch this site for updates. First, the SRA must ascertain where client funds are – at CCLS or ***** – and they will be in contact with clients once this has been ascertained.

    Just a good job that no-one with Watsons actually parted with money. Sounds grim for the these lot with the ones above. Watsons just need to get their act together and release files if they cannot deal with cases and let clients know.

    I've not heard anything from watson's yet either. I don't honestly think they're going to reply. Oh well. If they're going to treat clients this way then they don't deserve a business.

    What i posted above was to do with a business that was actually a closed down legal firm and Watsons are not so not alike but just posted it cause those clients are actually probably in a worse situation than clients of watsons as they have paid over money. At least with Watsons/Loancheck no-one paid over anything although it must be frustrating not getting any response from them.

    Yes was thinking may do that. Was going to go down but god only knows when. Also I believe that he works from a different office cause the telephone numbers are different. His mobile does not work anymore.
    (where has the shrug shoulders gone)-o- that is now my new shrug shoulders. LOL

    I wouldn't bother maxdp. It may be a wasted journey. I would though keep ringing. I am impatient as you know though so not everyone the same. I would certainly be ringing every hour and staying on hold. They have to get someone to talk to you surely by doing this. I know its not what you want to be spending your time doing but you need to know where you stand.

    Yes you are quite right, I was just concerned that if I did not complain down the official routes it would take longer if I just kept up with the phone calls. Will Sit down with good book on Monday and sit on hold.LOL

    Oh I would still go down all the official routes as well but I would also ring. Hope you get somewhere maxdp.

    Hello All,
    definately go down the official route, with the LCS. A section 44b notice allows recovery of your file by the LCS for investigation but if the solicitor does not respond he would be reported to the SRA as it is then a matter of his conduct (as in my case)

    The LCS can then try to recover your file under another power known as recovering papers under Solicitors Act 1974 schedule 1 part 1 paragraph 3(b) or simply paragraph 3 if successful under this notice they can pass the file to you.

    Although timescales do seem to drag on, if I had not complained I would still be no further forward than I was mid last year, at least now I feel someone who can do something is actually looking at the situation and it is still costing me nothing(apart from time), we are starting to think we may obtain enough information soon where we can make a decision whether to go to another solicitor. Length of time alone SEP 08 start with no movement on the case since April 09 may convince the SRA that he is not dealing with our case in a satisfactory manner and we should have the right to remove it without incurring any charges.

    Thanks for that Boberick. Certainly seems like you have been studying this for your case. Hope you get the right result for you and make the right decision for you in what to do next if you are released without charges.
