In reply to Purplenail's message. I would love to know how you managed to get a refund from FD without all the added stress of applying to the FSO? I'm in the same position as Jim and after FD advising that I had agreed to take out PPI on a loan in 2005, I complained to the FOS in February this year. I've received numerous letters from them (FOS) today being the most recent with the FOS advising that it could take at least a year as they are presently receiving 2500 complaints on a weekly basis, they will however update me in three months. Maybe Jim, myself and all the other unfortunate FD customers who haven't been lucky enough to get a quick refund should write to FD and ask them what process they undertake to establish who gets a straight forward refund and who will be unfortunate like myself and Jim have to wait months and months!... oops should say years0 -

I have missed the 6 months window I had to appeal to the FOS (by a year and a half for a lot of personal and practical reasons) so am I right to think that I can bin all the paperwork and write off my claim?0

We wrote to you on 9 September 2011 to say that HSBC had told us that it would like to make an offer to settle this complaint as a gesture of goodwill (with no admission of liability).
Further to your telephone conversation with my colleague, *******, on 10 October 2011, I can confirm that this letter was sent in error and HSBC has not made an offer to settle your complaint. Your complaint will therefore have to be assessed on it's merits. I sincerely apologise for the error. We will now expedite your complaint to ensure that is assessed on it's merits by an ombudsman as soon as possible.

I'm assuming the word expedite is meant to assure me that things will be slicker now.... I don't hold any confidence on that though, inspite of my best efforts to remain reasonable and not point any unjust fingers I feel a bit let down by the FOS, they haven't been very coherent the past few weeks.

Only found this post today, SWMBO submitted her claim to FD in Sept of this year as she was covered by her NHS employment (by the way the post is excellant and good on you for keeping it up to date and accurate throughout the saga), now is not the time however to get dis heartened , as an old manager of mine used to say - "keep your pecker up Neil"

Eth-Doc. I have no idea why FD reacted so quickly to my claim. The whole process took two phone calls and one letter from me. The first phone call was to ask for the documents relating to my loan. Upon receipt, I made the second phone call and they told me I had to send a letter of complaint, which I promptly did.
I had one holding letter from them and then the offer!
The whole process does seem very, very random. As someone else said, it would be interesting to know the criteria they use that allows one claim to sail through and another to be held up at every step.

I may be woefully incorrect on this yet I have a sneaking suspicion that only complaints made after the Judical Review malarkey are being dealt with in this "more straight forward and fair way". It's far easier to apply revised guidelines to new complaints.
I think that the complaints made after the JR were automatically being Properly dealt with before the long standing ones (the likes of mine for example). As infuriating as this is (and I am infuriated, because I hate standing patiently in a queue only to see someone else come along and get served straight away ahead of me) it does kind of make sense because if your complaint is with the FOS, then the bank already rejected it anyway and will have considerd it a closed matter.
So the banks have effectively ignored anything being dealt with the FOS, because as far as they're concerned they dealt with them already.
To me this is the only creditable explanation to why the likes of Purplenails (and this is not a swipe at you personally
) having relatively plain sailing and a quick(ish) resolution whilst the likes of me are still waiting ice-ages and forever being fobbed off.
It certainly annoys me to see the impatience and whining in other threads of posters who clearly only made their complaints after the JR, having resolutions of between 2 to 3 months from complaint to refund whilst I am still waiting after nearly 2 years.:www: Progress Report :www:

Just a quick thanks for the feedback on this thread, after reading I decided to put a claim in using the MSE forms in November 2011 for the loan that I had just finished paying off. My first loan was in 1993, and the usual happened since then, borrowing again, and again, which meant I had a loans for 18 years, but a new one was started every time I borrowed more.
Came back from my hols on Saturday to 2 letters, 1 offering me £7000, the other offering me £3000 (this was a joint 1 with the ex wife, so split 50:50, & she over the moon to get £1500 for a contribution of nothing). They went through all my loans that I had taken out.
I have accepted it, did not expect to get anything, never mind first time, but would not of got this without the advise from here, so thank you, never had more than £200 in the bank before.
I wish all of you the best in your claims.No longer posting on freebies or comps0 -
