First Direct - PPI missold claim

    I am also planning to claim PPI with FD. They sold me cover on a loan that is in joint names of me & my husband, yet the PPI only covers him. He is a long-term (13 years now) employee with a company & gets sickness benefits/statutory redundancy so looking back we just didn't need it. I am self-employed. Plus it was never explained to me whether I would remain liable for loan repayments if my husband fell ill/was made redundant.
    No idea what my chances are...!

    Kind of another useless update, since I am still yet to hear anything since the FOS got in contact to inform me that they advised First Direct to uphold my complaint, only for them to disagree and request a final decision, which was very nearly 6 months ago now.

    However a couple of days ago I asked my friend who works for HSBC, how it was going in the um..."PPI defence room" and he told me that he was no longer doing that and is back to usual duties and basically so is everyone else as well.

    It seems that this has something to do with the "JR" malarkey (which I'm not going to comment on too much because frankly, it goes over my head and I do not understand it!)

    So it seems that any further HSBC related PPI claim/complaint is being ignored (on hold) until this so callled "JR" dances it's...ah dance.

    I'm not quite how this affects my complaint since it was well in motion with the FOS before this "JR" thing cropped up, but I can only assume since that I have not heard anything to the contrary from either First Direct or FOS that my complaint process is still in motion (though obviously I could be woefully wrong on this count!).

    Very soon it will have been 9 months (6-9 months is the time-frame FOS refer to in their leaflets) since I received First Direct's "final response" and hence took my complaint to FOS, if I still haven't heard anything by mid December, I shall write to the FOS to chase up the situation.

    A satisfactory resolution to this situation is eagerly awaited by both myself and my overdraft.

    A slightly belated update from FOS's response to my letter.

    Basically, my complaint is still in the que of going to the final ombudsman. There's few words that could adequately describe the size of this que, though the chap told me not to expect any further progress for at least 6-12 months if even then.

    I think this just shows how much the public now distrust the banks for such a backlog of complaints being with the FOS.

    Basically, now... I shall simply have to assume my complaint failed, and assume I won't be getting any money back, until maybe out of the blue hearing different in the next couple of years. There certainly isn't any point on relying on a swift conclusion any-more.

    Ironically the thing I most need the money for will probably be paid off by the time it concludes anyway (assuming that it'd conclude in my favour), though I'm sure I'll be able to find other things to place the money towards, other debts, savings, deposit for mortgage etc.

    The queue is just getting longer and longer, and the current issue with the banks are not helping.

    It would just be a bonus if I got my my money back now.

    I have to simply forget about it, and manage my finances accordingly, and stop day dreaming about getting X grand back.

    Another non-update...update. However this letter from the FOS shows that I have not been forgotten!
    Your complaint about HSBC Plc (trading as first direct)

    As we have been unable to resolve your complaint informally, our next step is to refer the case to one of our ombudsmen for a decision. the ombudsmen will consider carefully what you and HSBC have said, before deciding formally how the complaint should be settled.

    Unfortunately, because of the very large number of complaints that are currently requiring a formal decision by an ombudsman, I do not expect that you will receive a decision on your case for at least six months and it may be longer.

    However I will write to you again as soon as possible - and certainly within two months - to keep in touch with you.

    An ombudsman's decision is final. Once an ombudsman has decided a case, it will not be possible for us to look at the complaint again. No ombudsman, however senior, has the right to overrule the decision of another ombudsman. However, if you decide not to accept the ombudsman's decision - when it is received - you will be free to take your dispute to a court instead, but we will not be able to give you legal advice about any court requirements or restrictions (for example on time limits).
