    All the letters, processes and questions you'll ever need to ask are there. For the last time now, if you want to pursue unenforceability then go and read the first 2 pages from start to end and you'll then know what to do from here on in.

    p.s. a little hint - send this! Debtors Final Response - No CCA Received

    and there was me feeling all very helpful today and the good advice is already being given by you niddy

    how could they insult you in that way and especially working for That company my most hated creditor of all time muppets:p

    Hi all been along time,so here's the update Mbna has issuses restons solicitors to issue a ccj against me at Northampton county court,I decided to defend the court action & got myself a defence solictor who wrote to restons informing they would defend me.today I've recieved a letter from restons stating I have no defence,that my solicitor is no longer action on my behalf and that they're taking me to my local county court,in the letter they have included a photo copied balance transfer,I'm at present trying to get in contact with my solicitor. Any advice out there please????

    Can anyone tell me when a lender has actually lost an unenforceability claim in court?

    I.e. where the judge has actually ruled that the debt was unenforcable?

    Might have been better to have given the money to your creditors in the first place, rather than handing it over to solicitors.

    Pull the other one mate, you're the one who was trying to take advantage of a "legal loophole" without the faintest idea of what you were doing, while at the same time quite clearly being morally obligated to pay back the debt.

    People like you make credit less affordable for the rest of us more honest folk. Of course I'm going to laugh at you, you've brought this entirely on yourself. At least most of the other posters here have ended up in a spiral of debt and have had no other way out, you're a chancer and a thief.

    So you dont want to repay the money you borrowed and you also want a refund of your PPI.

    Is it any wonder credit card interest rates are so high :D
