no never had it refunded,would it be worth trying to get it refunded only if i fail with cca? or get it back now,cant recall how much i paid.would i just be pushing my luck that little bit too far?0

Its your entitlement to reclaim mis-sold PPI - You usually apply this prior to sending in a CCA - the refund would reduce any debt on the account - see here for process: PPI Reclaiming Guide: £1000s for missold loan insurance...2010 - year of the troll

UPADTE! today i received a text message on my mobile from MBNA asking if i wanted to take advantage of a short settlement on my account,so i duely phone MBNA back once again i got the same snotty employee stating my account was due to go into default on friday,i mentioned the settlement,& he quickly came back with a figure of £3k to settle the debt in full,when i informed the said snotty employee i wanted to press on with the section 78 he quickly slammed the phone down,was i right to do this bearing in mind i didnt receive the settlement offer in writing?0

It wouldn't really have been slammed down. They would have pressed a button "slam down effect".
In fact, they don't even have buttons anymore. The rep would have "clicked" on a "slam down" virtual button on a screen.0 -
UPDATE!! MDNA have today replied to the letter i sent them stating that they were in default of my account due to them not sending me my true cca,they sent me two letters, one stating im in breach of paragraph 8 of my agreement & i must pay the arrears on the account immediately,before 25 march if i dont they will take further action against me,& the other letter states that they sent out my cca,& that they will continue to administer my account as normal,also with the letter was a poorly printed out sheet of paper with my information on,address dob job title etc,& a photo copied balance transfer sheet from 2002,surely these arent my cca are they???0
