how can MBAN sell the debt on? as they are in default the debt is none enforceable!!!! so surely a debt recovery agency has no chance of getting the money & they know this & are wasting thier time?? & yes ive sent a reminder several times,MBNA havent cashed my cheque!!!!!!!!!0

Well if they aren't cashing your cheque fine! Are you sending letters registered so you have proof of delivery? If not, start at the front again and send a CCA recorded delivery and complete the 4 steps as shown here: #2
Basically, if they have sold the debt whilst in dispute you send this: 11. Account sold whilst in Default of CCA Request
But if you never sent the CCA Request recorded and do not have proof of delivery then forget that and start at the beginning again cos they will deny receiving it.

done all previously,recorded delivery etc phoned MNBA about the very snotty letter today to test the water,& i spoke to very unhelpfull & arrogant person stating that MBNA are in default due to them not sending me the cca,his reply in a very stern manner was "we have done all that is required of us!!" i asked why my cheque hadnt been cashed? all the nice chap could reply was"err,err we dont have to cash your cheque" & swifly put the phone down!! As Jones used to say in DADS ARMY "THEY DONT LIKE IT UP EM"0

debt still not been sold on as yet,just seem to get letter after letter giving me one last chance,every letter seems to have the same theme,"this is your last chance" "time is running out" etc think im going to sit back for now & wait to see if they sell the debt on,then i will take the next set with the help from this forum!0

Is the only reason the account is in dispute the fact that you consider it unenforceable?. Or are there other issues?0

no theres no other issues,not what i know of,i did have ppi on it many years ago,& i struggled like hell to get it removed but after much persistance i had removed.0
