stratters1 wrote:Today I have received a Allocation Questionnaire and 'The Defence'. HSBC have scared me half to death by what they have put in their defence, to cut it down, they say that their charges are reasonable and are properly disclosed in the terms and conditions and published price list. They also say that UTCCRs are not applicable to them and therefore are not unfair contrary to the UTTCRs.
I am so confused by all of this jargon. On the questionnaire I need to add 'Other Information' to hel the judge clarify the claim etc. I don't know what it is I'm supposed to say. It asks if I have witnesses or experts, do I need these and if so, who?
Please can somebody offer me any advice.
Don't be scared, they have likely just entered a standard defence. Please see this thread:

for a link to the full guide to completing the allocation questionnaire.0 -
Thanks, I will start again as suggested. They have put an 8 week timescale on the £1000 offer, but it's a "No Deal" as I do believe that the figure will be higher and there that is what I am entitled to. Onward and upward! Letter requesting information now typed and ready to go.
Thanks very much, and good luck to everyone.0 -

Sorry but I have no knowledge of legal proceedings etc.

Stratters,
I wouldn't worry too much at this stage as from what I've read this is normal.
The way I see it is that the process is a simple numbers game.
If 100 customers get to your stage of the claim, and 45 do not proceed due to either the complicated jargon of the defence, (or the money/time it takes to complete the AQ) then that will be 45 less customers to pay.
In my opinion I think that different banks will have had different briefs on this issue, but most will revolve around ways to minimise the financial damage they are incurring.
I also believe that whilst the banks are focusing on damage control, they will also be trying to find some kind of loophole or way around the current predicament.
That being said, I feel that the banks best strategy at this time would be to either pay a low settlement at the early stages, or if (like in my case) this is rejected then to go as far as possible with the court process in the hope that a number of customers will back out in the later stages. So I feel that some banks are playing the numbers game.
Of course this is just my feeling, and is only based on my interpretation of what I've read and heard on this site.

Amount paid: 75% of claim
The story: Been a doddle all the way through thanks to this site. Sent request had statements and cheque returned within 14 days. Sent first letter, got usual brush off 3 days latter then offer of 50% of claim 7 days after that. Called em' up, said not happy with your offer, got a call back the next day with offer of 75%, didn't want anymore hassle so accepted yesterday by post. Good luck everyone else.
They cashed my chequeand I'm still waiting on statements prior to May 04

Hey there,
Bit of advice please. I sent the first letter asking for charges to be repaid, Natwest ignored the letter. Sent a second letter, the 7 days i gave them to respond is up tomorrow, so i was all set for filing my claim. Today i got what i think is a stalling letter, which basically says that they are sorry that i believe they have fallen below what is expected of them, and that they have passed the complaint to their Customer relations Unit (0800 015 4212). The letter said they would ring me in 2 days.
I rang them, and after getting cut off three times, spoke to a girl, who in turn rang Customer relations for me while she kept me on hold (as i'd been passed to the wrong dept) who said that the 2 days stated within the letter was a typing error, in fact, they will contact me within TEN days!
She went on to say that even ten days is optimistic, as due to the media coverage re bank charges, they are still dealing with claims from last October!
I have two questions if you wouldnt mind? Firstly, im off to Thailand for five weeks on Thursday, so any more letters that are sent i wont recieve. Plus, they HAVE responded, but is it just a stalling tactic? Do i just submit my claim now with the small claims court?
Kind regards, & happy new year:T The more money i save, the quicker i can buy my Audi0 -
Posting this again as I'm still stuck.
I sent my 14 day letter claiming £5700 charges and interest to Bank of Scotland on 11th December. No reply whatsoever so 7 day letter went yesterday. Concerned about the risk of High Court action. If I hear nothing in 7 days is it safer to go for just the charges £4800 and do it through the Small Claims process?
Is it unusual to hear nothing at all?
Also, I am still being charged on a weekly basis for returning items etc so there's going to be more to add; can i leave this until the Judgement stage or put it on the claim document?
Does anyone know if the Bank of Scotland's address for this action is The Mound, Edinburgh? I got it off their website for correspondence.
Thanks for any help.Lou0 -
It's ok, breathing big sigh of relief. Bank of Scotland's correct address is The Mound. Why no reply at all? But since Scotland is not part of England & Wales legal system, am i still ok to pursue them there?Lou0

Sorry to hear that jackie. I was very surprised for it all to have been over so quickly in my case. Hang on in there though, you will get your money. Good luck!

Is it possible to download the claim form so that the details can be typed in or do I just print it off and handwrite them? Also, not quite sure about the "blue" print in the middle. what does that bit mean?0
