section 59 - outrageous highway robbery?

So basically S59 it is a fast track method used by the police for motoring offences that would normally be dealt with under the road traffic act, driving without consideration, without due care and attention etc....
Sec 59s are generally used when the vehicle is being used in an anti social manner, so for example Motorbikes razzing up and down the road, loud exhausts (on a residential street and revving them) whereby they cause the public alarm/distress. They can be used for certain offences under the road traffic act as you stated but more often than not I would do them for the offence and give them either an NIP or summons for driving without due care or inconsiderate driving.Married 1st October 2015:heartpuls

I agree Inactive... but I really do hate the word "boy racers" I have always had nice cars since the age of 17 (saved up for them all myself).. not modified but nice clean examples visited may a owners club day in the past... and all I used to get from people was "oh you drive a nice car.. and your 17" "you must be a boy racer" it used to and still does grate on me.. im 27 now... been driving 10 years.. been stopped twice for general checks.. and so far have no points.. I drive everywhere below the speed limit and care very much for my car... but yet I am placed under the same bracket as a "boy racer" im sorry but it really gets on my goat!0

k18dan, I am exactly the same and used to get branded a girl racer and even though I'm 28 I still do now. Only difference being that I drive a much nicer car now (back in the day it was a 'supped up' Corsa which I loved) and am in the job myself so I know how not to drive, unlike a lot of these young ones that have just passed their tests and rag them around, causing an absolute nuisance and even more serious a danger to the public.Married 1st October 2015:heartpuls

I am the lad mentioned just spotted this on the PC when I turned it on.
The car I drive is an infamous Vauxhall Nova (the most boy racer car ever), it has no spoilers or chrome lights and is externally standard, the engine is modified because as standard it had 44bhp in 1990 so not too usable on a daily drive to work on the motorway. I wouldn’t consider myself a boy racer, however fully understand that that is how I am perceived.
My first section 59 was because I was pulled over, the police officer had no proof or evidence for speeding but claimed that "the noise the car made meant I must have been speeding" this to me is not logical. The second was the exact same thing, I tried to explain that the engine is modified (insured and taxed as modified with costs me 1100 pa) and can be very loud even at the speed limit, the response to which was yeah well I don’t have any evidence of you speeding but it doesn’t matter your car is being towed (at a cost of 150 quid and 20 more for every 24hrs).
Now I have plenty of friends who are part of the Maccy D chav crew and speed round in 1.0 Saxos with spoilers and Lexus lights however I don’t believe myself to be one of these. If I was caught doing 35mph in a 30 I would hold my hands up and take it on the chin, however I don’t see that one Police Officer can be judge, jury and executioner.
I found all your comments interesting except Inactive making comments about how I am a moron and deserve everything I get, please don’t tar everyone under 25 with the same brush and make offensive comments, it makes you look like a Keyboard Warrior.
Finally I do realize that dangerous driving kills plenty of young drivers each year (many of my friends have died or been injured) and the police should enforce speed limits and try and kerb this behavior or if people do not take heed of warnings remove the from the road, but if I had been driving a VW Passat in the same manor I wouldn’t have got this Section 59 and I believe that without evidence of any kind I shouldn’t be fined and have my car taken away.

Yeh we are able to issue s.59 warnings. I would go as far as saying its our most valuable power available to us.
so virtually any tom !!!!!! or harry can give these out.
im sorry but i think this power is a dangerous one. i know a few police officers and wouldn't trust them with this power....work permit granted!0
