Hope someone can give advice
I am on a DMP at present and would like to reclaim my overdraught charges from the above bank. The interest for a number of months is over £30 plus a £5 usage fee per month. Is it possible to reclaim these charges back or is it the norm what they charge

Whilst we feel £30 charges are too high the banks don't and the court ruling also stated so in 2010.
You can claim a refund of your charges only if you feel you fit the hardship criteria (see MSE site for all the details on how to do it). You have to have a very strong case to do this and even then, there is no guarantee you would win. Nothing to lose by trying though.0 -

I have used template letters to push my bank charges claim through and I recieved a letter from the senior centre manager of the Customer Response Service Unit stating they are happy with the courts verdict on the matter etc and if I was not happy and couldnt come to an arrangement within 8 weeks the case would be closed.
I then sent a template financial hardship letter straight away in december...I then phoned the direct number two weeks ago because I had heard nothing from them....turns out they had not received anything...so I sent another letter last week to make sure.
I have tried to get in touch with them today but the direct number(0845 3030 442) does not work and no department to do with my RBS claim knows how to get in contact with them..so...what do I do next? I cant go to the financial ombudsmen service until I receive my final response...but on the other hand the next 10-20 letters I send could "get lost in the post".

Firstly, reading your earlier post of 8 Dec. it looks as though you might have some difficulty reclaiming anyway as, although you are in hardship now, the bank could ask why you feel you want to reclaim the charges from 2003 because, from what I believe you to mean, you were not in hardship then and let the charges spiral due to spending (and I don't mean that unkindly).
I tried the telephone number you quoted and it is an automated ansaphone message regarding the court ruling. It suggests if you have a complaint to go on line and follow the contact us link to making a complaint.
There is another number. 08457 242424 however, when I wrote my original letter of complaint I sent it to
RBS. Customer Response Services Unit
Drummond House, First Floor, 1 Redheughs Avenue, Edinburgh
EH12 9JN. (The telephone number for that is same as you have)
Regarding their comment 'if I was not happy and couldnt come to an arrangement within 8 weeks the case would be closed' what were they meaning? An offer of a sum or a dmp? You could always inform them of a figure you would be prepared to accept. Study the MSE site for guidance.
Incidentally it's always better to send all letters by recorded post, at least that way, you know if your letter has been received and it only costs 78p plus the stamp.
I got the brush off and final response fairly early on from RBS but will persue due to hardship at time of charges and now.

I recently sent in a claim for over £2000 and Lloyds have made a direct payment of £200 and have waived £65 of recent charges, we applied under the hardship rule,is it worth trying to get any more back from Lloyds??:eek:0 -
this may be wrong thread so apologies if it is and if able to direct me then thanks in advance.
i had 2 accts joint with ex at nationwide, we split and agreed he took 1 with £2500 od and i took one with a £500 od. i made sure his name was removed as per the procedure and had my wages transferred. he didnt. he left me struggling with a £2500 visa which was in my name but he had a card(which i cancelled as agreed ), he agreed to seel shares we had so i could set up new place and pay cc. he then said he wasnt. i checked interent bank and my name was still on the other acct, i enquired with bank who said i hadnt been removed and also with lawyer who said until my name removed i was still resonsible for half any debt on acct. i therefore transferred online the amount for visa from this acct to mine, went to bank and paid visa in full.
ex went nuts as expected and contacted nationwide who transferred the od to my acct in my name alone from the joint acct, which put me over limit. this was 3 years ago and i had forgotten about it. however i am trying to deal with my debts and get back on even keel again. any advise as to how to deal with this and have the od removed. i was advised as i didnt agree to the od being moved to my acct nor was advised that this was illegal, i was advised this should have remained on and in joint acct and acct frozen with us both liable for half of the anount.
stupidly i have now settled financially with ex and forgot about this, but as is nationwides fault that my name wasnt removed and then as a reaction they moved the money to me rather than leave in an authorised od acct is there anything i can do to have this debt written off? long shot but can but try!!!0 -
I have twice started to prepare a claim and stopped due to some confusion on reclaiming. Can any1 tell me, if I am currently paying back a credit card loan from a number of years ago through debt collectors i.e. Capital 1 card loan being sold to Aktiv Kapital, would I still be able to claim PPI even though this loan is poss 11/12 yers old!0

Its all well and good stating you can reclaim bank charges now if your in hardship,
But what if at the time a few years ago with these bank charges and you were experiancing hardship then and not now.
Has any one tested claiming hardship at the time of charges rather than now?0 -
Hi can anyone help, we've had to send our complaint to ombudsman for unfair charges(£32 each!), with Santander and they've come back saying they're not upholding as the charges are not deemed unfair! Not impressed at all, I don't think £32 is a fair charge and I'm gobsmacked that the ombudsman isn't doing anything! In the letter it says I can take it further with them, what can I do?

Since the court ruling your complaint would only have be considered had it been under the hardship rule. As your complaint was about unfairness I don't think there is anything you can do. It seems hard I know as those charges are absolutely humungous:(0 -
at the time it was hardship im afraid and that was what we had put in the letter, the charges were escalating and couldnt pay money into the account quick enough! we just believe that they were unfair, does this change anything?0
