    I am in financial hardship and the FOS has agreed with me. I am not a stupid person, my problem was I took ill....

    No one has said you are stupid. The information you have been given on this thread is correct, the bank decides whether you are in hardship according to your income and outgoings, and non essential spending would significantly weaken your claim.

    Did nobody watch Martin's programme last night? It was all about reclaiming, and not about financial hardship.

    No, I did not watch the programme, sensationalist journalism is not my thing. Bank charges reclaiming for reasons other than hardship ended long ago.

    People on benefits are allowed to buy anything they want to, but they cannot then claim they are in financial hardship as a result!

    I am looking into raising a claim for bank charges for financial hardship.

    What charges am I able to claim? Just the bank charges or the charges and the overdraft interest charges as well? I am aware you can claim the interest for the charges but I have 'charges' and 'interest' charges on my statements.

    You can't "claim" anything. You contact your bank to let them know you're struggling financially and they will contact you to discuss it in more detail.

    When they have looked at your accounts and what has caused the charges, they will decide whether you are in financial hardship. If you are, they might consider refunding some charges, they might not, it's their decision, not yours.

    If you have any non essential spending on your accounts, things like cable/satellite TV, mobile phone contracts, gym memberships/ eating out etc, it's difficult to claim you're in financial hardship so bear this in mind when speaking to them.

    You know when I went for help to a charity when I was in debt, they advised me that you are still allowed to have a life, whilst owing money. So you are allowed to smoke, go on holidays etc. These banks will just have to pay for the damage they did, and are still doing it.

    I don't have a job, I have a heart condition, I don't smoke or have Sky or cable. I haven't had a holiday since I had to stop work. I still have a life though without EVER having paid 1p in bank charges. Banks have not done me any damage at all.
