    We stopped DD payments on there say so as the OH was waiting on someone getting back to him about lowering payments. Got a letter through dated 25th January stating he had £600 of arrears. So god know's where we stand if we have apparently breached the contract. Yet there calls should be recorded so hopefully thats proof?

    Everybody that has been affected should contact Watchdog and get them to highlight the story. I have done so already.

  • I have dug through my paperwork for my financial agreement and this is what I found.

    The Consumer Credit Act 1974 lays down certain requirements for your protection which should have been complied with when this agreement was made. If they were not, we cannot enforcethis agreement without getting a court order.

    The Act also gives you a number of rights:

    1) You can settle this agreement at any time by giving notice in writing and paying off the amount you owe under the agreement which may be reduced by a rebate. Examples indicating the amount you have to pay appear in the agreement.

    NO THE JUICY PARTS

    2) If you received unsatisfactory goods or services paid for under this agreement you may have the right to sue the supplier, us or both.

    3) If the contract is not fulfilled, perhaps because the supplier has gone out of business, you may still be able to sue us.

    If you would like to know more about your rights under the Act, contact either your local Trading Standards Department or your nearest Citizens Advice Bureau.

    MISSING PAYMENTS: Missing payments could have severe consequences and make obtaining credit more difficult.
  • i checked and seen that anglo capital advent and all the other training companies attatched are all the same companies my bank has cancelled my direct debit in case of fraudulant claiming by anglo try because even though it went bust a week ago its still collecting monies and my bank refunded mine they took yesterday

    Hello All,

    My stomach turned when I got the email from Advent on Wednesday night.

    I called Barclays on thursday morning and asked what is going on - they said

    "they are looking for another company to take over the training and I should get something in the post within the next 3-5 days. If they can't find another company then the agreement would be cancelled."

    I was really surprised and relieved - I did say to the lady (didn't get a reference number or name as I was having palpitations) to confirm that there is no way that I would be liable for the loan, and she replied with a 'No' and when I aksed if I would get any money back that I have paid she said 'Yes'

    I am going to call them again tomorrow and get a ref number and try and get an email or something confirming this in writing, FINGERS CROSSED IA it will work out for the best for all of us in some way!

    I also called the Consumer Direct group

    who advised to send a "RECORDED LETTER" stating that Advent are in Breach of contract under the consumer credit act section 75. She advised to send it to Barclays too as they are in partnership of some form. In the letter to Barclays state that you will not be paying anything more of the finance as the agreement has been breached, give both companies a deadline to reply to you by; and what you want them to answer with.

    In the letter to Advent state
    that need to provide other means of training.

    Will get the letter off tomorrow - also on the website she mentioned there is a link there that provides letter templates
