    It is not frightening to have powerless people sending misleading letters.
    To the contrary it must be quite enjoyable to anyone with knowledge of the facts.

    There is no debt, as a cursory examination of fundamental commercial law taking less than thirty minutes will demonstrate to anyone..

    My partner has received a Parking Charge Notice for being 11 minutes over the three hours allowed. She was not driving at the time and, interestingly, the photos on the letter clearly show her in the passenger seat but it is not possible to see who is driving. Of course she is doing her best to remember but her memory is not what it was.;)

    Allow me to use this forum to set out her case, any comments would be appreciated.

    The camera that has taken the photos appears to be at the entrance/exit to the retail park. This is on a busy junction and the car would have been queuing to get out for several minutes and this can not be considered 'parking' time. Also, it is a large retail park and the car was moved during the period to be closer to the shops being visited, this is also not 'parking' time.

    Parking is free at this retail park but typical charges for paid car parks in the town is £1 for two hours. If she had wanted to stay longer than the 3 hours she would have been happy to pay a £1 to cover the additional time. It was a weekday morning and there was plenty of spaces available in the car park.

    She is ignoring the notice for the following reasons

    1. She was not driving.
    2. The actual time parked, i.e. stationary in a parking bay is not recorded but will certainly be less than the 191 minutes on the notice.
    3. The £75 'charge' is excessive given the cost of paid car parks in the town.
    4. It was a quiet period, there were plenty of free parking bays so the shop were not being deprived of business.

    My advice to her is to do nothing, ignore the letters and if anyone comes to the door just tell them to go away. Any further tips from you good people would be appreciated.
