First plus unfair rebate

Hello,
I complained to first plus re unfair rebate 2 years ago (feb 2008) they eventually offered 50%.
I did not accept this amount and took my complaint to FOS it was with FOS for 18 months and still awaiting adjudicator!:(
Because of continuing financial difficulties i got fed up of waiting and wrote to FP to accept their initial offer.
I have just had a letter back from them saying their offer doesnt stand....great!!
So i just thought i would post this ...not to put people off but just to make them aware of what can happen

I have to say i was hoping for this to pay out and i am really peed off.
Should i phone FOS and let them know to keep on wiht the complaint for what it is worth. Hi anychance, i won an unfair rebate but it was not with FP (although the loan was with FP) but the rebate complaint is against the insurer and nothing to do with FIrstplus. I am sure that the FOS KNOW this and will be sorting on your behalf. I made the complaint against FP for the rebate and after toing and froing for 8 months they wrote to my insurer on my behalf. DO you know who the insurer was? Was this an old loan before they became regulated by the FSA. They were actually GISC members since November, 2001 so if your loan was taken since then and it was actually firstplus that sold the loan and PPI then you should be going for a misselling complaint and FOS WILL adjudicate.ANY_CHANCE wrote: »Hello,

Anychance, did you ever resubmit the complaint for misselling against Norton Insurance Services limited as your policy was sold AFTER regulation so you should not have been turned away by FOS in the first place. There was some confusion with FOS as Norton were not regulated but ALL sales of insurance were regulated since Jan 2005 and your sale was May 2005 so would have HAD to have been regulated. I would write to FOS again and make the complaint against Norton Insurance Services Limited and tell them it was THEIR mistake for sending you away in the firstplace. I really feel for all that had this problem and just hope they actually move the complaint immediately for the misselling as it was actually them that caused the problem in the firstplace. You should not have to make a rebate complaint as it was actually missold and if missold you should be put back into the position as if you never had the PPI at all and FOS have jurisdiction over it.

I didnt resubmit the complaint. motivation a bit lacking in this dept. I think it took me ages to complain initially then there was alot of confusion and when they (FOS) rejected the complaint it kinda burst my bubble.
Then i was hoping for the rebate to work out.
However i have started to get stuff together to resend to FOS. I really am not sure what i should be sending but here is a list
My origional complaint dated 20/2/08 to first plus
first plus reply saying norton sold policy 26/2/08
Norton letter saying they were responsible for sale 27/2/08
Norton letter deny of any wrong doing 22/4/08
My second letter of complaint 10/6/08
Nortons DSAR return of 10.00 letter 28/7/08
My origional FOS complaint against Norton 26/7/08
FOS reply stating they cant look at it 13/8/08
and a letter stating:-
Our complaint is regarding the Loan and single premium payment protection insurance that was sold to us by Norton Finance. We complained to the Financial Ombudsman Service in July 2008 but this was returned I enclose the letters.
It is recently that I have become aware that you have reconsidered this and are now looking at these cases.
Do i need to do any thing else or add anything else?

Remember I said I was giving the insurer/underwriter direction a go?
With the help and encouragement from Marshallka as well, I went ahead with this and this is now just waiting to be passed on to the adjudicator, because originally it was send back in a few times and then returned to me, so far so good though its going the way we want it to.

Our complaint is regarding the Loan and single premium payment protection insurance that was sold to us by Norton Finance. We complained to the Financial Ombudsman in July 2008 but this was returned explaining that you could not look at the case.
It is recently that I have become aware that you are now looking at these cases again as all sales of insurance were regulated since Jan 2005 and this sale was May 2005 so it would have had to have been regulated.
The complaint remains the same as that of the complaint 26/7/08. That we were mis-sold the PPI by Norton Finance and that the terms and conditions were unfair.
I would also like to add that the continued pressure of financial difficulties due to this dispute not being resolved has lead to the sale of our family home and breakdown in our marriage and family unit. I am now a single parent of three children and a student nurse experiencing financial difficulty with the threat of order of sale on my home. I am making token payments to creditors.
So therefore I would be grateful if you could fast track this complaint
