Our complaint is regarding the Loan and single premium payment protection insurance that was sold to us by Norton Finance. We complained to the Financial Ombudsman in July 2008 but this was returned explaining that you could not look at the case.

So therefore I would be grateful if you could fast track this complaint
What you do is treat this the same way as you have done with the broker, the FOS are now also trying to make the insurer/underwriter responsible and are taking on these complaints.
Marshallka is the one to explain in detail for you here, I expect she will be along soon and give some advice/info on this hun.
With mine if you remember the broker dissolved and I even tried the lender direction instead but still had them returned to me, because none of them were goverened when I taken mine out in November 2004, so since some advice and help from Marshallka I gave the insurer a go, even though they came back with a letter and said they were not responsible, then saying it was all down to HFC bank.
The FOS told me to resubmit all my paperwork and recent letters that incude the insurer, then within a few weeks they wrote back to say they were collecting further information from Hamilton the insurer, and a few weeks back they sent a letter to say its now waiting to be passed on to an adjudicator.

Too true anychance. You are due it all back and not just an unfair rebate complaint. It was FOS who has this wrong. Its just that Norton Finance were not under FOS jurisdiction until July 2007 (I think) BUT when they were selling insurance in Jan 2005 they had to be regulated so they sold it under their principals being "Norton Insurance Services Limited". This is why FOS got it all wrong with Norton complaints. You need to explain it to FOS that your original complaint against Norton still stands but you were unaware that their Principals were actually Norton Insurance Services Limited and they WERE regulated at the time of your sale. It is really errors between Firstplus and Norton and also FOS as none of them told you EXACTLY who to make the complaint against. You need to detail this in a letter and ask that they look into this immediately as the error was partly their fault. You do not need to go the insurer way or the underwriter way. Yours is just an ordinary complaint for misselling against the firm that sold it to you being "Norton Insurance Services Limited". You really need to tell FOS your complaint is actually against NORTON INSURANCE SERVICES LIMITED.0 -

Just for anyone here that does not understand. I had a complaint against Firstplus who were not regulated at the time of my loan and also did not sell the PPI (but I tried to make them responsible) and FOS dismissed the complaint quite righly due to the fact they had no jurisdiction. I then submitted the complaint against Barclays Trading As Firstplus (as Barclays actually own FP) but again this was dismissed. I then asked for an explanation as I thought that Barclays WERE definately under their jurisdiction at the time of my sale BUT it was then explained to me by a manager at FOS that even though a larger firm owns a company in terms of jurisdiction issues it does not matter UNLESS the smaller firm is actually a tied agent of the larger firm (which FP were not where Barclays are concerned).
There was a case a couple of years ago whereby a person was in the same boat as Anychance and had their policy sold (SPOLL was the name) via Norton Finance and AFTER regulation (ALL sales of insurance choose who actually sold the insurance, were regulated since 14th Jan 2005). I could not understand why FOS had thrown it back so I noticed that on the FSA register Norton Finance were actually tied agents to a firm Norton Insurance Services Limited. It was then that Spoll resubmitted the complaint and FOS were able to adjudicate as normal.
All that happens when you actually submit to FOS if that the people that put the complaints forward look for the firm name and not the actual dates and complaints and if the firm name is only under jurisdiction since say 2007 then they dismiss. What they fail to do is look for appointed representatives/tied agents and the date that they were under jursidiction. You can hold a tied agent/appointed representative responsible for a failing within a firm. This is why Norton insurance services limited are actually responsible for the failings of Norton Finance.0 -
