Had no reply from FOS to say they got the letter,
Today had a letter from Norton saying the FOS had sent them a letter and they (Norton) have already issued a final response and the complaint is outside the time scale. WHAT THE???
Rang FOS they have no record of my new complaint or the complaint in 2008“most people give up just as they are about to achieve success”If you think you are going through hell keep going - Sir Winston ChurchillIf You Can't Change It, Change the Way You Think About It.SW, 13st5lb, -4 1/2, -1,(12st13.5lbs)0 -

No didnt send it recorded delivery as had no problems before
I have the paper work they sent rejecting the complaint
I can resend (by recorded delivery!!) and with a covering letter.
Think i will add that they must have received my letter otherwise why would Norton have said they had been contacted by FOS“most people give up just as they are about to achieve success”If you think you are going through hell keep going - Sir Winston ChurchillIf You Can't Change It, Change the Way You Think About It.SW, 13st5lb, -4 1/2, -1,(12st13.5lbs)0 -
I spoke earlier to complaints dept at FOS she said that They could not look at any Norton complaint but that in some cases they were looking at the underwriters as well but only in some complaints.“most people give up just as they are about to achieve success”If you think you are going through hell keep going - Sir Winston ChurchillIf You Can't Change It, Change the Way You Think About It.SW, 13st5lb, -4 1/2, -1,(12st13.5lbs)0

I know that this happened to someone called spoll and they made the complaint against Norton Finance. It was sent back EVEN THOUGH it was sold after regulations began. It was then that we found out that Norton were "appointed representatives" of Norton Insurance Services Limited and therefore the complaint came under that name Trading as Norton Finance. I would contact the FSA about this and see what they about FOS turning away complaints for a firm that actually had a principal that was covered by the FSA for the date of the sold insurance. It may be worth a shot as Spoll resubmitted and it was then accepted.ANY_CHANCE wrote: »I spoke earlier to complaints dept at FOS she said that They could not look at any Norton complaint but that in some cases they were looking at the underwriters as well but only in some complaints.
As i was explained by FOS if a firm is an appointed representative of another firm that is regulated then they are acting as "agents".

I would ask FOS to explain how your policy was not covered by them as it was sold after regulation and the firm is still trading now. Did they sell it breaking the rules????0 -
Thanks Marshalka
I will definately resend the complaint (you never know i may have forgotten to add some paperwork) and hopefully they will reply with their reason
I wont speak to the FOS by phone because at the moment i get flustered and i cannot concentrate on what they say, best to write it down“most people give up just as they are about to achieve success”If you think you are going through hell keep going - Sir Winston ChurchillIf You Can't Change It, Change the Way You Think About It.SW, 13st5lb, -4 1/2, -1,(12st13.5lbs)0 -

Hi there
normally it is that of the broker, but some are going the insurer/underwriter direction, as the FOS are trying to make these responsible as well, so many of us have gone that direction, especially if the broker was not regulated when taken out the loan, for example by GISC where the FSA taken over in Jan 2005.
What year did you take out your loan?
If after Jan 05 you should be okay, and write back and tell them you do not agree with the decision, if they have given the final decision then yes contact the FOS first to make sure they can help, here:

If for when you taken out the loan the broker Norton were regulated by the above, you can then just move on to the FOS to complain, otherwise the insurer/underwriter direction, the broker should supply you with the details on request.

If you want to double check with the FOS first though and take it from there, good luck.;)The one and only "Dizzy Di"
