    Because the Subaru had them fitted at the factory, the Nissan didn't - if you make modifications to a car, they have to comply with the current 'legislation'.

    But that's not the case for any other modifications you make to a car.

    For example, if I were to swap a brand new R35 GTR engine into my old Nissan I wouldn't have to comply with modern emissions regulations. I could run that engine catless if I wanted and still only have to comply with the emissions applicible to my car (ie. <=3.5% CO and <=1200 ppm HC) even though I have a modern engine that was designed around modern emissions regs.

    Why is this different when it comes to vehicle lighting?

    Because the EU is a lumbering bureaucracy with ill thought through policies.
