Hi All, I wasn't thinking about not paying it back but using it if the creditor won't accept my DMP....ie it's not enforceable so BACK OFF (Littlewoods, Crap One....)

I agree, having thought about it, you guys are right, if they play dirty then the CCA route maybe the only option. Fight fire with fire.

We've probably already paid back what we've borrowed with the outragous interest over time, esp in our case with mbna:mad:

    Morning All

I think the statute barred thing is when you have not acknowledged the debt for 5 years in Scotland and 6 in England. I think it applies to those people who tend to move a lot and have lost touch with creditors etc, I'm afraid in that respect we're all truly b####### as we have been and are paying so we are acknowledging the debt, unless anyone feels they could hide for the next 5/6 years?? Let me know where/how and I'll come too.
The CCA thing is is to d with wether or not they have a proper signed agreement, if they don't I think you don't have to pay it but they will still try to get you to, so mainly I see it as a way to get a cheaper full and final. Prof this sits better with the paying back what we owe as you will be just less some of the huge amounts of interest they have added on. Have I got this right or am I away with the fairies???

Sorry you are making perfect sense so no day off with the fairies for you PDD!
Mmmm hiding for 6 years that'd be the caribbean for me I think...

Absolutely - we owe MBNA a lot, but for years what we've paid has only been the interest which was around 30%!!
