    I was hoping for info regarding what other people would do and to see whether anyone could offer further help or personal experience of a similar situation. Maybe even get some support while i'm going through it...something a solicitor doesn't include in the package.

    Of course it isn't against forum rules but if you have taken professional advice then other than support, which on here will probably be in short supply I was curious to see what you were looking for.

    Because they said it to you, it is not libel but if they have humiliated you in public, you should be entitled to reasonable redress for the distress and inconvenience you have been caused.

    Given the circumstances as detailed by Natalie, then - yes, it is not libel (though libel can, of course, comprise the spoken word).

    But it is probably still defamation, for which a civil case alleging slander could potentially be initiated (though most lawyers would likely do their utmost to avoid escalating to this extent).

    Whatever course of action you follow, whether it's a complaint to the bank, to the FSA, legal action, a newspaper story, whatever... just steer clear of phrases like "emotionally fragile", because you'll be a bit of a laughing stock if you don't. Yes, it can't have been a pleasant experience, but that just makes it sound like you're milking it, tbh.
  • LOL...i've written it professionally and just used facts. No emotive language and no feeling sorry for myself! Sent the letter to the bank today recorded delivery.

  • How can i check how much they have given me if i have no account cards with me as of yet? They didn't inform me how much this "goodwill gesture" is...which tells me it isnt an awful lot. If something doesn't ring true...that is down to the banks, and not myself! Thanks for the constructive responses though guys

    When the operator told you a goodwill payment had been made you didn't think to ask how much?

    You obviously have a phone relationship going with them, the time you spent on here moaning you could have called them and asked.
