no document is legal that is signed and witnessed by the same person. But have to say, I'm struggling to understand exactly what's happened to who.

DH signed it as MR X and MRS Y. Mrs Y ownes half the property and land. MR X had nothing to do with it. Mum told him to sign MR X and MRS Y.

MRS Y has said she never signed it and MR X says he never signed it.

MRS Y is entitled to half of the property but now MRS Y wants to take my mum to court because of the property etc and she wants her money.

ah right. Forgery - can only suggest if the police are involved the forger presents themselves at a police station and confesses, and mum will have to deal with whatever comes her way.

Does anyone know what will happen next? I mean will the police come and arrest DH with handcuffs or not? When he gets pulled in will he be ok etc?

The investigating officer will phone DH to arrange a time and date for DH to attend the police station. He or she will then speak to the custody officer and book a time for DH to attend. He or she will phone DH back to confirm the time and date.

When the date arrives, DH will go the the public enquiry desk and ask for the Investigating Officer. He will be taken to the custody suite. He may have to wait in a holding area if there are a lot of detainees and the custody officer is busy.

If Dh doesn't turn up at the appointment, a police van will arrive at your house and DH will be arrested, searched and put into a cage in the back of the van with an escorting officer. No handcuffs, unless he is violent, likely to harm himself or likely to escape.

Also see my advice about what to do and say once in the Custody Suite.

The interview will be recorded. There will be a lot of paperwork and administration and DH may well have to sit in a cell while it's completed. I would guess that DH will be bailed to come back to the station, giving the Investigating Officer some time to interview the co-conspirator and the solicitor witness, and to confer with the Crown Prosecution Service.

    Hope that helps.

So when DH attends to the police station does he say nothing or does he call a solicitor? Do you know how long the process takes? What if no one presses charges what will happen?

Sorry to ask but i dont know the legal system neither does DH.

Many Thanks for the reply it has helped
