Please try not to get too upset about it, wait until you have the interview as you dont actually know what they have got on you! My friend had this happen to her and at the interview there were photos of her partner leaving and entering the house and all of the times and dates etc when he was there. If he was there alot they will probably see it as he was living with you especially as his mail was sent there. Just be honest with them and tell them why you had the mail delivered to your address etc, I really dont think your looking at a prison sentance, maybe just a slap on the wrist, fine or you might be asked to pay it back?!? So what you're saying is...if I'm open and honest (telling them he never lived me but stayed over 2-3 times a week to help me, love me and be a general carer/boyfriend) and yes his mail was sent here (they already know that because he works for the council) and because he doesnt have utility bills /proof (but does have a testimonial from previous landlord/friend) I will have to pay back 2 years worth of all 3 benefits?
Because they are UNLIKELEY to believe...surely they need proof? to prosecute me or Maybe I should lie and say yes he's been here all that time and ive been claiming while hes working for the council...the very people who are interviwing us under caution.
Sorry but if that was my intention then I certainly wouldn't of had his mail coming here!

As your husband seems to have absolutely no proof that he lived elsewhere during the period involved then they're very likely to believe that he was living with you at the time and that you were claiming benefits you weren't entitled to. How have the council come to know about this..? I guess someone has grassed you up. Just be honest, i don't know if the outcome will be what you want but i wouldn't go thinking prison etc. The one bad thing i can see is as others have pointed out, the mail coming to your house. Was his old place shared then..? How exactly did the mail go missing..?. What is his job within the council..?. I maybe wrong here but a conviction for fraud could very well mean he gets the sack too.0

They have proof, the letters. Plus they may have more proof that you have not seen yet (they will present at interview).
I would not go in demanding proof or trying to lie, I would go in and answer questions honestly and openly.
That will be the best outcome for you.

I have an idea it was my ex husband who probabley "grassed" me up!...we've had major problems between us with solicitors and threats from him..anyway..

The only way people can give useful advice is if they have ALL the facts.
On another point, they do not need "proof", they make their decision on "the balance of probability".
Can I ask you a couple of things?
1. When did you decide to marry (you presumably booked registrars, other stuff at some point)?
2. When did you decide to start "living together"?
3. Where did he live before moving in with you; was it the same address all the time you were boyfriend & girlfriend?
4. If he was staying with a friend, why would his post not be safe, and therefore why did he need to use your address? And why for work - do they send a lot of valuables through the post?
5. Has he used your address for other purposes? Bank? Credit cards?0 -
But it's not IS who are asking you to attend an interview it's your council, that would be why I am talking about HB and CTB.No, because dla isnt means tested and when i got advice from income support when we started going out after 18 months they advised me that if he paid the bills or moved in then I would have to declare it*SIGH*
