Rented house end of contract, deposit etc

Oh gawd I was hoping it might not turn out as bad as first thought. Its really bad if he does do something like that as shes lived there on her own and works long hours so is not even in the house that much. The house has been kept really nice, shes made sure the gardens are always neat and tidy and she was even talking about having the carpets cleaned before she moves out last night by borrowing a friends cleaner even though theres nothing wrong with them apart from a few spots here and there that were there when she moved in, but she will remove those anyway. There is one big one (about 16 inch diameter) that was hidden under a chair belonging to the owners. The house is white carpets all through the house so shes had rugs down everywhere from the start to protect them. I told her not to bother going to the trouble of cleaning them as she hasnt got time plus theres no inventory, they are no different from when she moved in apart from some she removed herself that were there when she moved in, so its cleaner than before.
I'm thinking of getting them to record the check out visit with a voice recorder in case he says something stupid or tries to still say she has to pay the 30% of the first months rent for the new tenants if they move in like he said she would have toThanx

Your daughter should not worry about cleaning the carpets if she doesn't have the time. As I said, if there was no check-in inventory which stated clearly the condition of the property and its contents the landlord will have no proof whatsoever that any stains or even wear were your daughter's responsibility.
Right now, what she must be focusing on is the landlord's address and the return of the keys to the agent. Whatever he might have to say about rent due is not of interest, you have already been told what your daughter's liabilities are. He may have his opinion but you are in possession of the facts.0 -
your daughter s landlord is a police officer , contact his superior and it will be sorted out the same day................................we all have bad days , some more than others ..................0

Yesterday the agent rang to re schedual the viewing time to tonight and while on the phone without my daughter saying anything he said 'don't worry about the deposit I will bring it with me on Sunday' she said he seemed like he really wanted her to know this.
He turned up tonight with both sets of people for the vewing so he did 2 at the same time, is this normal practise to have more than 1 interested party viewing at the same time?
Daughter said he was really nervous talking to her and kept forgetting what he had said. He asked her 'Where did you get all the information about the tenancy so you could leave?' he said it had shocked him and he had even spoken to the landlady about it but she had said all she is interested in is getting the rent on the 1st of the month.
The landlady has also said if my daughter wants any of the furniture from the house she is welcome to it as she isnt interested in any of the furniture. Seems weird to me as the house is advertised as furnished. She also said my daughter doesnt have to bother returning a chair she stored in my garage as it was in the way, but she doesnt want the chair or any of the furniture.
The agent said I'll check over the house now whilst I'm here but everything looks fine and just barely flitted through the house saying yes everyting is fine I'll bring deposit on Sunday, I think it seems he just wants to give it her back to avoid any trouble its obviously scared him. He said after he got her letter they have now changed all of thier contracts. But changing the contracts isnt going to alter the fact that people can leave on the last day of fixed term does it. I don't know how they have changed it but recieving the letter has definitely had an affect on him anyway and we are hoping things will go smoothly on Sunday.
I think he probably will turn up Sunday as one of the viewers gave him a deposit while they were there so he will want the keys.
Daughter was quite surprised though that when the viewers had left he told her there was another appointment booked tomorrow evening for another couple to view it and was it ok, but daughter said well if they have just given you a deposit there is no point is there and he said ok I'll just show them the house accross the road instead as its similar to this one.Thanx

Any information about furniture and the like should be taken with a pinch of salt as far as I'm concerned and I'd certainly return that chair out of storage, just to be absolutely on the safe-side.
Sounds like a bit of decent advice has got this berk sitting up and taking notice! Will you please come back after check-out and return of the keys to let us know how your daughter got on with her deposit?0 -
Of course I will, I would not just leave it after all the help everyone has given me here but its looking fairly likely that he will hopefully return it.
I was thinking about him saying they had now changed all of thier contracts and wonder if he might have changed them from ast agreements to some other kind where the tenant might not have the right to leave the way my daughter is going toThanx

no landlord can put any clause in any agreement which contravenes Housing Acts... it would just be unenforceable.......

Agent did not turn up at first for the 1pm meeting they had arranged, she waited 45 mins then texted him but he didnt reply, she waited another 10 minutes then rang him and he answered denying the 1pm arrangement. He said he would be there at 6pm as it said that in the letter, no time was stated in the letter just a request that he contact her so they could come to an agreement for a time which they did do on the night of the veiwing for 1pm. He is so disorganised he can't even get an appointment right. Daughter suggested he re-read the letter. He then said well she was in his diary for 6pm so he would be there at 6pm.
He turned up at 6.30pm and wouldnt look her boyfriend in the face, he already had a letter signed by himself stating that the house had been checked, there were no defects in the property and the deposit would be in her bank account between 7-10 days, he also gave her the landladys name and address and signed the alknowledgement for return of keys my daughter prepared beforehand.
Everything seems to be ok but till the money is in her account its not finished, will let you know when that happens
Thankyou to everyone for the help with this. Pressuming the money does go in fine I am sure that he would not have handed the deposit back to her for one reason or another if he hadnt been scared off by the mse de-rangers :rotfl:Thankyou so much for your helpThanx

I don't suppose a single person on here will accept any thanks until and unless that fool has deposited the funds in her bank account and you can confirm same.
