She has checked her payments with statements and she must have had it set up to go out on 19th of each month by standing order as this is how it goes
1 - June 18th full months cash payment
2 - July 20th (Mon) full months payment
3 - Aug 19th (Weds) full months payment
4 - Sept 21st (Monday) full months payment
5 - Oct 19th (Monday) full months payment
6 - Nov 19th (Thursday) full months payment
7 - Dec 21st (Monday) full months payment
Hes saying the one in July arrived on 26th which is why he says she owes a weeks rent
I think its best to wait for deposit to go into her account too thats if it gets there and then decide what to do but I want to see what fantastical idea he comes up with to try and make her believe she owes him a weeks rent. Some people might fall for his pathetic scams unfortunately
Hoping it will go in quickly and then she can remind him about the ladlords address in writing.
There is something in the tenancy that states if payments are late that there is a charge to do with bank charges, would these payments be classed as late?Thanx

It looks like all payment should have been received in the agent's bank account BY the 18th of every month so I reckon her payments were made late in months 2 through to 7. A pity but I'm not certain what penalties might legally be levied for late payment0

In the areement particulars it says
Rent: per calendar monthly in advance commencing from 18th June 2009 and payable on the 18th day of each month by standing order.
In tenants obligations it says
To pay the rent as stated in the 'particulars' at these times and in the manner specified in this agreement and that in the event of the tenant failing to do pay any or all of the rent on the date that the rent is due, to pay interest at the rate of 4% over Barclays Bank PLC Base Rate (such interest to be calculated upon a daily basis) until payment is actually made.Thanx

would these payments be classed as late ? - yes - all payments except the first one are late... rent is due to be in the LLs bank account in cleared funds on the rental period date... which for your daughter was 18th of the month...
if he cannot work out that she does not owe a weeks rent, he will never work out 4% (per annum) above BBR for 2, 3 and 4 days !! even if he could, it will be pence... so dont even think about that as something to worry about.....0 -
That is what it says in her statements, would this be the date the payment actually arrived in the agents account? its Halifax. I thought it was set at 17th to go out but then thought 18th when she told me the dates going by the Mondays. If it had been me I would have set it earlier to arrive as you say by 18th each month. Why wouldnt he complain though if he knew. But anyway this is not the reason hes saying she owes him money he is saying she owes him a weeks rentThanx

Let him claim it's outstanding rent and then make him prove it. It might take him a fortnight and a dozen calenders but he can't so don't worry about it. The real worry is getting the deposit back in full as expected.0

At the time she moved in there and over these last few months she has had a lot of things to deal with, moving areas, moving jobs, moving house, car going bust which is essential to her work and splitting up from a 5 year relationship and that is just the start of it. She should have set the standing order earlier by a few days but in all the chaos it got overlookedThanx

I just asked her exactly what his explanation was and he said because the rent was due on 18th July and he recieved it on 26th July she owes a weeks rent as the rent she paid on 26th will be for rent from 26th july to 26th August :rotfl:and so on so therefore she owes a weeks rent. What is inside his head! he should be scaring birds in a cornfieldThanx

I doubt he would be competent to do even that, quite frankly! Let's hope he's got enough fingers and toes to count and reach the right number for her deposit transaction.
I'd love to be in court and see the judge's face when he tries to justify his calculations to reclaim this "outstanding" rent. Oh, yes I would!0 -
