Well!! I just spoke to argos again, and they claim mine was not any where near the despatch point- v.sorry! So told them makes no difference at all payment point was contract formed etc etc, and someone is going to call me back after they have spoken to legal team. clocks ticking!0

ive now been told they were FAULTY !!!!!!! hence recalled
apparanlty manufacturer recalled them not argos (hmm more lies)
and apparantly i will get my order and i need to ring after 4 as she cannot get into my original order as its being 'delt with' apparantly those who orded and had theres dispatched will recive one
watch this space later i will update as to if i get anywhere, can they now try and charge full priceDebt free :beer:

Nope, no full price, you will be charged the same. They have different stories for all, as long as they fulfill it now it doesnt really matter what excuse they have/had. I wonder if watchdog have also been on their case for an explanation0 -
Its a shame they dont use Royal Mail because they would never get them back once the items were collected.I usually like to drink my whisky neat :cool2:0

and as said above i think its this site, hduk etc that has helped everyone argos must realise now there is too many unhappy people who have been chatting to each other about it

Grrrr I had given up and now this, lol. What if their website stated despatched but I have no tracking number or proof?
FloFlo, ring HDNL and give them your postcode, they can trace it on that. They will give you the tracking number and you can put it into the their website & print it off 0871 977 0800.
My AD number is still showing on the Argos website as dispatched, so you should still be able to get a print up of it.

I too have had a call from the Directors team at head office. They have said that the point of law was when then contract was formed? In their T&C's, it states that when the item is dispatched the contract is made. Therefore they are now agreeing that all who's order dispatched are entitled to the dsi at the reduced price. I had supplied a screenprint of their tracking service showing dspatch, so she is now arranging for a dsi to be at my local store for collection later.
I did ask if we were going to get anything to make up for inconvenience, but she said no, seeing as we were getting a half price dsi lol. To be fair, I decided not to press it
Anyone that can show the item was dispatched, speak to the directors office at argos HQ, and you should get sorted from there. Incidentally, apart from arguing the case on New Years Eve (when i was meant to get delivery), I hadnt got round to writing a letter, so this was pretty much a call out of the blue. Theyd obviuosly kept my details since then.

Mine was cancelled before dispatch so I will be in the same boat as you. My cc statement shows a debit of £85.xx on the 30th and also a credit on the same day. Does that mean the money was only reserved as opposed to actually taken, I wonder?

OMG.....Exactly the same has just happened to me!!!
Hope I'm not being too premature, but just wanted to say a big thank you to everyone who contributed to this thread especially those in the legal know such as Cheshire_Carper & Ironside.
Keep fighting to those who haven't had a resolution as yet, you might still get a phone call today xx0
