I have posted this earlier, to make it more recent:
This 'dispatch' status will create further issues for the vendor legally (and morally in terms of public relations). It is not a bar to the contract. Further, one simply has to ask, what is the criteria to be in this 'dispatched' group. If for example, customer A purchases at 10:00am and ends in the dispatched pile and customer B purchases at 9:45am and purely on the grounds of the call handler does not end up in the dispatch group.
Both customer A and customer B have affirmed contracts with the vendor, simply, their internal system has selectively chosen who is and is not in 'dispatched status'. And to continue, as the poster alludes above, he is unaware whether the dispatch occurred.
A question the vendor needs to think long and hard about - if they could not be 'dispatched' (let's assume stock level limits) then why was an order number given and why were the funds debited from the buyers account? The affirmation of the contract has occurred by the vendor's actions.
The dispatch status is not what affirms the contract. The contract is affirmed when English law says it is affirmed. That is defined in the hurdles that must be met in law.0 -

A result here!! being dispached for delivery on Sat. I did not prove they had dispached 1st time round. Just stuck to point of contract being made.
