argos have only refunded me for the ds and not for the shipping of it

i rung customer services and lack of sleep meant ive gone right into one

bloke i spoke to reckons argos was NOT in the wrong and we have nothing against them !

said my lack of full refund and a phone call was a mis sioght and they should have contacted me blah blah blah

question is do we have anything, they took my payment in full then recalled my order and then refunded me minus the shipping cost

I just rang and asked where my refund was and was told 'oh i'll process it now!' when i said that i had been told it had already been processed on 31 Dec I was told 'oh yes it was processed on the 31 Dec but you need to wait 7-10 days for the banks to process it'.

I have never had a refund that has been processed by a company take 7-10 days, I told her it might take Argos 7-10 days to process the refund to my bank but certainy not my bank taking that amount of time!

I'm sure this has been posted already but have a look for "elements of a contract" and ask if each has been met.

From what I've seen here they have so good luck to all involved.

Personally I don't hold with all this "no contract until we dispatch" guff as it favours the seller too much.

I just want a refund now, Amazon have the black DSi my daughter wants for £119 and I have about £20 in vouchers but want my refund so that i can buy it before price goes up.

They cant charge delivery on something that was never delivered!!! We arent paying for their fuggin mistake. Seems to me like they are trying to claw back every penny they can cuz loads of people took advantage of the misprice in-store.

Breaking news just had argos on the phone..............................they are sending my item they have had a change of heart today and anyone that showed as despatched will get them. Mines coming monday get on the phone to them now ......was allowed any colour as well . Good luck you guys

As I said, an eminently winnable case. Well done for sticking by your position. The vendor was in the wrong from the beginning and has clearly seen sense. Maybe the direction on the law has put the reality of the situation in front of their respective noses
