I have just contacted trading standards. They did say the loss of bargain, only applies if I could have also bought from another shop at the same price.
I'm suprised at this lack of knowledge by Trading Standards.
But there again nothing much suprises me anymore.
IMHO I would say keep it simple and do not be sidetracked by seeking alternative remedies at this stage.
You want Argos to honour the contract for the black nintendo Dsi lite for £79.99 (plus delivery).
If you start pursuing damages for "loss of bargain" at this stage, you are saying something along the lines of " Look Argos, because you breached our contract, I have had to go to X store and pay £149.99 for the black nintendo DSi Lite. This is £70 more, and I therefore want £70 off you"

I suspect it's more a case of misunderstanding than anything else. Sometimes 'could' and 'couldn't' aren't all that distinct over a phone line. Perhaps it's just a simple misheard comment.

See Ironside's comment above. Ignore loss of bargain, concentrate on enforcing the contract.0

Trading Standards (Consumer Direct) told me yesterday that Loss of Bargain could be incorporated into the equation. However they have said that primarily it is a Breach of Contract - so I'm just going to concentrate on that initially.0

I not had chance to do my letter yet, still trying to sort out xmas stuff with a 3 and 4 year old untidying stuff as I'm tidying! I will be sending one off though, as soon as can get round to it, the more people that send the more of a stance... As one of the above posts, I'm gutted not got the dsi but its more of a "loss of faith" with them, not knowing now whether sale items are true!0

Rosatoso wont be forwarding copies until they have gotten a response back for the original. I cant say I blame you though just be upfront about it. Anyone that can help me in writing mines I just need a paragraph that clearly states what Argos did wrong and why. Im not after a law degree on a page. Thanks in advance.0

Back on topic - it's not sounding too positive, which is suprising as two people I've spoken to with legal background have opined that this blatant breach of contract.
Maybe Argos have dodged a bullet.0
