    I was one of those who ordered on the phone, have a screen print to show dispatch, but it never got delivered.

    What action are people taking, and what phrasing are people using?

    I have just rang The Trading Standards Authority (Consumer Direct) and reported this. They state that Argos are definitely in Breach of Contract as money has been exchanged.

    They say to write to the Argos MD stating they are in Breach of Contract and also include a Claim for Loss of Bargain. They have given me a reference number and say they will also be checking into this themselves, especially in light of the volume of calls they have received. So please ring them. 08454 04 05 06.

    Just got off the phone to the TS advice line, the woman said she would inform Trading Standards as it was misleading advertising. And they were in breach of contract as long as it was in stock. But if it wasn't in stock then there was nothing they could do but refund me.

    Another complaint to the list, though, at least.

    Might be also ringing Consumer Direct at least they can have it all on one database unless you all ring the same trading standards office

    It was in stock as they sent them out and then recalled them.

    If someone maybe wants to post this on HUKD too, so others can make complaints too if they wish, I'm not a member.

    Can the person who offered to give a copy of their letter to HO please send me it so I have an idea of what to write. I wont be sending a carbon copy if thats what they are worried about.

    Yes, I'm not worried about that. Just waiting for Cheshire_Carper to look over it for me to do with the legal bit whenever they get a spare minute.
