If payment has been taken, then they have to honor the deal as per the sales of goods act. A price was advertised (error or not) giving an offer to treat. If Argos then take payment they have accepted your offer to by at that price and have formally entered a contract. This is why many online stores dont actually charge you until dispatch giving them ample time to resolve any errors. Argos and anyone else can write what ever they like in there terms and conditions but if any of those terms go against your statatury rights, your rights overide the terms and conditions. If payment has been taken argue the fact, if payment hasn't been taken then you don't have a leg to stand on. If you was in the store and they advertised it instore at £79 and only charged you £79, they cant call you up later and say we've made a mistake and would like our other £79 please. The same applies to online purchases as well as high street purchases.
So can you win if they ring to cancel your phone order? Anyone ever tried with argos and won about phone order?0 -
gutted!!! rang up and the said it was pricing error and it has now been removed and now £149.99
oh well... well done to those who did get it at £79.99!!0 -
Thank you so much to the person who mentioned an HDUK person getting a pricematch with Gamestation. My hubby took a screenshot of the Argos offer to Gamestation after work and asked if they'd match. They were aware of the Argos problem but said that they'd rather get the money than Argos!!! We now have a DSI for £79.99 for our DD's birthday woop woop!!!!!!!!!! :j:j:j
Still think the Argos store manager is a complete waste of space with no customer service whatsoever. He even refused to give his surname for security reasons...despite his name being on his badge and my hubby standing 2 feet in front of him. Security risk!!!0 -

4.3 The price you pay is the price displayed on this website at the time we receive your order apart from the following two exceptions:
a) For products reserved online for store pick up or any other reservation service the price you pay is the price in store on the day of collection.
b) While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.Next year we'll be millionaires!0 -

Theres terms do not apply to Mandles because his/her order was a telephone order. Unless Mandles was read these terms specifically over the phone, or was told where to find them and explicitly asked to accept them.
During my telephone call to place an order I was read no terms nor pointed in the direction of any.0 -
