I don't know anyone that could go with me to look at a car. I guess this is why I'm in this mess. I emailed them last night and said I really didn't want it and could we replace it with another car, but so far not heard back.

Please, please speak with them directly, they're not all bad.

Tell them you've spoken with friends who think it might be dodgy about him changing the mileage and would like more time to look into alternatives with them.

As for the typo, i've done it before, i've written something in word and copied and pasted it to a number of sites. it may just be an honest mistake, but ideally you want to try and guilt him into backing out of the deal, not cancel the cheque, otherwise you'll have a whole host of problems over the next few weeks
  • I feel sick about this.

If it was an honest mistake, he could have said that, not tried to make out that I hadn't read it properly. And then sneakily change it after I had left.

Anyway, I just rang them. The main guy in the office is on another phone call and got to wait for him to ring me back. It was another guy there that sold me the car, and it's his day off today.

First off, learn from this - do not let it happen again.

Don't get youself so worked up over something that you might not be able to change. In all honesty you were happy enough to pay for the car on the day, and you will get used to it eventually, plus it offers the accessability that you were looking for for your mum, so that's a plus.

Like others have said, you could get parking sensors fitted to ease your mind when manouvering :o

As for when he rings you back, tell him what you've told us about seeing the mileage on other sites, you feel like you've been mis-sold, and you'd just like to see other cars as you felt like you were pushed into it on the day.

Ask him again, politely to look for other cars for you and give him assurances that you do actually want to buy a car, just not this one

    Good luck hun ;)

Stopping the cheque stops them getting the money now, nothing else. (Out of courtesy, tell them you've stopped it which will avoid them getting bank charges over a returned cheque - unless it's already in the system. If so offer to pay the fee)

Once they have your money, getting them to refund it will be near impossible.

But there is a chance that they give in when the cheque bounces back. Worth a try!

But should they insist a deal is a deal, and want to enforce the contract, there won't be "a whole host of problems" at all unless you refuse to honour your side of the contract and not pay them, and the problems you get over reneging on a contract will be none the worse for stopping the cheque now.
  • Thanks for the info guys. He's still not rang me back, and i have to go out now as I have to be at mums. I can cancel the cheque there and ring him back there if i need to.

Good advice from Carlos there. Don't get yourself too worked up over it.

If worst comes to worst you will have to sell the car on again in a few months if you don't get on with it. You will take a bit of a financial loss but it's not the end of the world.

Front and rear parking sensors would also help your situation as someone above suggested. Maybe this will make you feel more comfortable with the car.

Listen, if you cancel the cheque he will likely incur a fee for that, and he will be very annoyed to find out that way that you are going back on the deal. YOU HAVE ENTERED INTO A CONTRACT TO BUY THE CAR. He can sue you for the full amount plus costs and interest if you cancel that cheque. The advice a couple of posters gave you about cancelling the cheque is wrong.

You need to be a grown up and talk to the salesman face to face, and see what they can do for you. They'll probably let you walk away from the deal after paying a small fee, see what they say.

You don't just go around buying stuff then cancelling cheques. You just don't.

If that were the case, there would be no facility to stop one.

As previously posted, the worst that can happen over stopping the cheque is the garage asks the customer to refund any charge the Bank made over the cheque (if it has been paid in), and the deal has to be honoured.

But there is a chance the garage take the view that they want to keep a happy customer, and the car can easily be sold anyway.

But once they have the money, getting them to agree to cancel the deal and issue a refund will be highly unlikely!

It's worth a go, if the OP is dead against the car, and has no significant downside.

Im not too certain and cant remember too well however how ever as far as contract law goes, he has made a offer, you have made payment as acceptance but you can revoke your acceptance as his acceptance is only made when the cheque has cleared, because when he accepts the car becomes yours. Until the cheque clears you are not in contract.

Just cancel the ceque, tell him what you done. Go there and discuss the issue with the mileage and that you read that any car with odometer problems, usually have this again and again and should be steered clear of. Also mention to him that it maybe a con and the mileage may have been X and he has taken it down to Y to increase price. Ask him for all previous MOT's, all service history and this should be an indication to what is going on. One of my mates brought a Fiesta from ford. It was brand new and had odometer problems, he would drive a mile and get like 10 miles or more on his odometer. Within a week he was on 2,000 miles. He took it back to Ford who gave his money back as they could not fix it. They gave him a focus as a courtesy car until they repaired his car which failed for something like 6 months. After 6 months they refunded him.

What ever car you get there is a simple solution.

    You sit in the car.
Get friend to stand in front of car, with leg touching the bumper, make mental note of the cars dimensions.
    And away you go.
