Request for refund for Christmas tree (soil!)

I wondered if anyone could let me know if my letter is clear enough and not too emotional:

To Whom It May Concern

I am writing to request a complete refund for the X type of Christmas Tree and delivery charge.

I selected 'Delivery Before 5pm' and my item arrived at 5:20pm, after the agreed time. Your website terms state this is not reason for refund, but your Delivery page states: "Delays can occur with the courier delivery services. Such delays are beyond our control and as such qualify the order for a refund."

The Courier placed the item in my hallway, and as he stepped back, it became obvious that there was a leak and soil was on the carpet. He offered an apology, and handed the form for me to sign. I signed, but stated that there was mess left and the goods were not in good quality. I have enclosed a picture of the tree and the soil on the carpet. This was as the tree was placed by the courier.

Upon unwrapping the tree, it is clear that due to the large amount of soil that was lost, the tree is unstable.

I ordered a 4ft tree, but the tree stands 6ft high. I have enclosed a picture of the tree next to my 6ft husband for comparison.

Due to these issues, I feel I have not recieved the item nor the service I paid for, and request a full refund of £X.

I've tried to keep it clear and not ranty. However, would it help my case if I mention about me specifically ordering a tree for delivery due to my disability, and things like this not helping matters? I also have a picture of the pot that shows it being unstable, should I include that?

    Why did you accept the tree if you did not think that it was of a satisfactory quality?

    Do you intend to return the tree? You have not stated this.
    Gone ... or have I?

    The goods appeared to be satisfactory quality - it was only when unwrapped that it was obvious it was unstable and too tall. I mention that I wrote on the form that there was a mess, so they can't say that I didn't mention it to the courier.

    I'm happy for them to collect the item, I won't be using the item as it isn't suitable.

  • Why not ask for a partial refund and add some more soil to the tree to make it stable?

    Do you think that would be the fairest outcome?

    The tree is too large to be used inside, so if I keep it, I'll have to just plant it and hope it'll be an outdoor tree.

    Why don't you just get a saw and cut 2 foot off the bottom? Then put it back in some soil and water, and it'll be fine over Christmas.

    If your husband is the same size as the tree, do you keep him outdoors as well?

    It's nearly Christmas and therefore should be a time of goodwill. My advice would be to pass the tree outside to your husband and ask him to cut a couple of feet off the bottom. Not only will this mean that you can then enjoy your tree indoors, it will also help him to keep warm as it is quite chilly outside (does he have his own kennel? Does it have central heating?).

    Once this is accomplished, you will be able to decorate your new tree with lots of festive lights that your husband will be able to admire through the window. Perfect.

    You contradict yourself in the letter:

    OP you forgot to mention the baby that could have been hurt had they eaten the soil from the carpet and that you require to be compensated for the possibilty of mental anguish had that happened.
  • I wonder if Christmas Tree producers employ special staff to measure trees - sorry I know it's off topic slightly but imagine having to measure trees all day.

    OP we had a tree once that was too big and we lopped some off the bottom and then got this sort of round log thing with a hole in the middle and stuck the tree into it - turned out to be the best tree we ever had and didn't even shed very much. As it is so near Christmas that is probably your best option as you might now struggle to get an inch perfect tree.
