advice on injury in a store

  • I am very surprised this was not entered into the accident book in store. You really should have insisted on it, as now the incident has not been recorded, details are difficult to prove.

    If anything I hope you informed them of the legal consequences of not recording these things in the log. At my place everything from a death to a broken nail (if it draws blood) goes in.

    How do you know the incident hasn't been recorded?

    They have acknowledged it took place due to the letter. Whether it has been officially recorded, I am not sure.

    OP - what did the letter actually say?

    You could try complaining to head office directly, it sounds as though the letter has come from the store. The store I worked in did not have access to company headed paper, all official letters had to come from head office. To send a letter, the store had to send a draught letter to head office and they would take over from there. Also, we weren't allowed cages (unitainers) on the shop floor while the store was open we had to break the delivery down onto trolleys for H&S reasons.

    Because the OP would have had to have been present to give personal details such as contact address and phone number.

    Since he has not mentioned this, and also noted mother/wife 'wandering off', I came to the conclusion that it was not recorded. The shop assistant's blase response also suggests protocol was not followed.

    Please feel free to correct me if I'm wrong.

    Check out the Companies Act. All correspondence from a limited liability company must accord with certain requirements - company name (in full), registered office, address, etc.

    Seriously though people do die and it does have to go in the book. When I worked in a supermarket I heard about a few eldery customers who would come in and literally drop dead whilst doing their shopping. Horrible but it does happen sometimes.

    That is probably the reason why all correspondence in our regional store was handled at Head Office level.
