Update and question about CAFCASS

Hello all

We now have some progress with our PWC.

OH has been to solicitors and applied for PR plus a CO (basically just to cement the current arrangement and ensure he can see his DD at Christmas and take her on holiday - both things that the PWC has stopped / threatened to stop this year).

PWC has still been 'at it' - refusing to hand over school uniform, insulting text messages, blocking access blah blah and OH now has a court date before Christmas to get this sorted - PWC will be getting the letter today so no doubt there'll be fireworks this week!

Anyway - OH was a bit unclear about this when he spoke to the solictor. He seemed to think that on the day CAFCASS would want to talk to DD. Does this sound right? She's only 8. OH isn't asking for any additional access - what do you think?

    Yes the CAFCASS officer will want to talk to her, just to get a feel for how she is doing with all of this, and how it affects her.

    Nothing to worry about especially not as she spends time with you a fair bit already.;)

    Thanks K - more worried about her than us to be honest! PWC isn't going to take this well and I'd put my house on the fact she'll be 'prepping' DSD in the run up.

    Ah well - will just have to take it as it comes then!

    On this point the CAFCASS bod will talk to the child with noone else there, they should also talk to the schoole. They did with mine anyway.

    i cant remeber your case off hand, but why would the child be present for an initial hearing. i'm confused? :confused:

    first thing that will happen is you'll be sent into a separate room with a mediator before you go in front of the judge.

    I don't know Speedster - that's why OH thinks he may have got it wrong. I was wondering if DD would only be involved further down the line if the PWC contests any of it.

    OH hasn't heard anything from her and she must have had the letter by now.....very odd. He's worried she'll just dispose of it and deny any knowledge of having received it so won't turn up to court.

    I won't be attending. OH has chosen to be heard separately to his X. No idea what to expect! Any tips?!

    maggied you woundnt be allowed in anyway, only the egal reps are as for cafcass speaking to dd they might not the didnt with my 13 year old

    It's usually down to the judge to instruct the court reporter (CAFCASS) which won't happen until at least the first hearing. It's not usual for 8 yr olds to attend court.

    It's not necessarily the case that you won't be allowed in. It's down to both parties and the judge's discretion. I was allowed in to the session when the NRP didn't bother to turn up.

    cafcass would only be involved from the off if,when he filed the c100 he ticked "yes" to Q.5 (risk)

    did he file a c9 (statrment of service) too?

    also, did he send the c100 recorded, signed for? if you're up against a contact blocker, that's a must.

    if not, one option is to send her a polite text "reminding her" of the court date.

    and i'm sorry to say it, but his solicitor sounds sh1te. :mad: he should have gone through the whole process.

    i cant think why he'd think the child would be there, let alone dragged in on aninitial hearing.

    i'd get shot of him before he milks you of thousands.

  • Cheers speedster - I think it might be more to do with OH not listening than the solicitor being rubbish ;) - he's done everything he said he would so far....

    I've no idea whether he's sent the letter recorded or not. What would happen if she didn't turn up?

    I wouldn't attend anyway - it's not my battle (in that way) and I think my presence would only prove to be inflammatory! It would be nice to see the expression on her face when she's informed that she won't be able to block access because of whatever she'd decided to get her knickers in a twist about that week.
