    Anyone can appeal any decision - that has never changed - whether he wins will depend upon his circumstances. Under CS1 all dividends were taken into account as a matter of course.

    Kelloggs In my eyes it is the way they done it and got greedy and backdate it nearly 1 /1/2 years after they had calculated it wrongly by using the wrong figures .There is references of me calling which was confirmed on the phone and then it was finaly sorted out Sep 04 and backdated to Jul 04 (£5.80)back to what i should have been paying .

    Called them Monday 1st and she said she was going to get case papers .

    Letter dated 2nd she retracted it by stating i didn't follow the appeals booklet even though she quoted me (which i have a copy of) all the phone calls i made regarding this .Off to the complaints dept again by the looks of it .:mad:

    Sifting through the data prints they went for liability the week after .They have now exposed themselves in the way they have gathered the evidence that i had received dividends .I have a full audit trail of all the anomolies .It's going to be hard to get them to back down .In my opinion though they haven't followed the law as they went for one period then backdated it 1 1/2 years .
    They had intimidated the accounts dept as well turning up at the door on the guise of DWP

    They will not look at it again as probably they know they have screwed up .The excuse is i didn't appeal it at the time even though my data protection files are full of references when the assesments were issued :mad:

    I wrote a letter in which i thought was an appeal but there is evidence there me disputing it 1 month after the 2nd assesment .I have to give all the evidence to the MP tomorrow as i have sent in a letter of complaint .My dp files are full of references regarding this .

    I see - I take it you didn't get a response from that letter? Did you specifically state in the correspondence that you wished to appeal - or did you just say that you don't agree with the decision?

    I didn't agree and asked for it to be revised which they declined of course .There was so much going on at the time with them liabilty orders so conflicting letters etc .I wasn't clued up at the time about s etc and was never explained to me on the phone .They can't span a dividend figure over the space of 2 years that is the point i am trying to get to them .

    How would i go about appealing their inclusion as it is now sitting with the complaints team now .I have all the paperwork at hand to go to my MP tomorrow .
