If it was awarded via a departure you will have got a letter saying so - under CS1 all dividends will have been counted as income under a normal assessment - not a departure.0

Thanks Kelloggs
There was no departure then as i said in obe of the other posts they used the dividends for 2002 and carried it on till 2004 and backdated them .I have copies of letters complaining etc but they never acted on it util Sep 2004 .So i will have grounds of getting that taken off mt so called arrears .
So that means they owe me money :j
Wonder how long they will string it out0 -

I called them tonight to pre empt them a letter is coming and the woman said they wouldn't review it as it was refused a review when i complained at the time .They said the accoutant supplied them the details .I asked them to check the records at companies house and even offered her the £1 t followed the correct legislation .Because of the limited time this happened as i was first notified in Dec 2003 it was backdated to Sep 2003 and then reassesed Feb 2004 and backdated to July 2002 .The woman couldn't understand that they had used the wrong dividends per financial year even though they weren't paid to me .She confirmed all the times i called and i have copies of letters i sent . It wasnt until Sep 04 (backdated to July 2004) that my payments went back to £5.60 per week .
