Toshiba Cashback Terms & Condtions........Are they Unfair

  • Amazon are pretty good, eh? Shame i didn't buy mine there. I've contacted Trading Standards to see what their opinion of the 'within 7 days' clause is and whether it's unfair. I've also copied in nigel.evans@toshiba.co.uk in my latest email, not sure if it's the correct address but i found it on google.

I've also contacted Consumer Direct and await their response. I have mentioned to them the variance in the T's & C's between the TV and laptop cashbacks. I guess the likes of Watchdog and the consumer peeps in the press will be next.

  • I think the main point of all complaints should focus on WHEN the date of registration is.
Their Terms & Conditions are quite specific and you can't argue with them. It's the interpretation of when you bought the item that seems to be catching most people out.
The fact that THEY require your Serial Number to register is important. You don't get this until you have actually received the item. Given varying delivery times, this can be upto 14 days later, making it impossible for you to register within the required 7 days.
It is clear this offer was designed for people walking into a shop and taking the item home with them, there and then. They didn't give much consideration for mail order or internet sales, where a delivery time would come into the reckoning.
Now they are trying to wriggle their way out of the offer by stating that the time of purchase is the correct registration date, which is, of course, IMPOSSIBLE because you don't have the serial number!
    Just a point to remember.

    Claretblue,

Have you had your £50 from Amazon yet?

  • "These amounts will be returned to your payment instruments within 10 business days."

In other words, they're paying it back to my credit card. I'll let you know when.

Don't the conditions have to be fair though? Especially when you see Toshiba using totally different conditions to claim cashback if you have purchased a laptop.

Its upto them who they give cashback to, The terms are fair it seems they are aimed at users buying in a store.

Amazon paid £50 into my credit card this morning (Tuesday). Not bad considering I only asked them about this on Friday!

They are not very fair for those ordering via the internet. Neither do the T's and C's compare very well with other Toshiba cashbacks such as the one they are running for their laptops. The buyer has to wait 30 days to register and then they have 30 days in which to register the product. That covers nicely any delays in delivering a laptop ordered over the internet as well as a generous 30 days to register.

Nice result. And it contradicts what Amazon told me last night that they would not under any circumstances offer such a refund.
