I have considered it very clearly. The terms that you agreed to state clearly no contract is formed until the item is dispatched hence Tesco have acted perfectly legitimately and you wouldnt have any legal recourse.
If you think otherwise I invite you to make a legal reasonable argument. Im going to bet you dont because your just claiming you know what your on about.0 -
As a non-lawyer, I am perplexed by your attitude Anihilator.
If the law is so black and white, how come there are so many lawyers making a mint out of convincing their clients that the law says XXX, while the opposing lawyer tells their client, the law says YYY.
I have learned the hard way that a heck of a lot of the stuff lawyers spout is absolute rubbish, just to keep the payments coming in, but there are numerous occasions when judgements/decisions have turned out to be a complete surprise to the professionals themselves....isn't that supposed to be how a lot of the laws work, by evolution and interpretation?
It is my understanding ( from personal experience, and from life in general) that where the law is concerned, nothing is certain until the fat lady sings,...... and then there are the appeals which overthrow the first courts decision, then the high court who throw out what the appeal court decided.....
If the law is as absolute as you seem to imply, how can presumably perfectly competent judges come out with such differing decisions ?
Anyway, back on topic - well, more on topic....;)
I ordered one game (not 20) for my son.. My one was cancelled, despite them taking the money.
Would you please give a legal definition, (since you claim to be such a legal expert), on what the difference is between a mis-price, and an offer ????
As others have already cited, there are numerous examples where items have been sold well below their rrp and it is not a mis-price, and retailers do not necessarily take out full page ads in the papers for this to be an 'offer'.
I got the Cof D2 game for £26 from Sainsburys - I call that a bargain, not a mis-price.:p0 -

Other than that, retailers offer ridiculous discounts on many different products. I once purchased an item from a store that price-matched the shop next door... who were offering the item for £70 less! Neither store were promoting the product as anything other than a straight sale!
Anyway, you seem to be choosing to ignore the fact that Tesco took payment for the item (and haven't refunded yet) despite their T&C's saying they will not do so until despatch. For their T&C's to be correct, what exactly do they mean by despatch? Is it when they take payment, when they book the courier, when the courier collects, when it leaves their premises, when it gets to the end of their road? I would argue that despatch and payment taken form the same thing in this instance.
Also, taking payment has been explained to me by Tesco as being a system error. That would never stand up to scrutiny!
Finally... I ordered one copy for me... Anihilator, how many copies did you order?

Right I am very fed up now it has been 10 days since i ordered this game and 7 days since the money was charged to my card and still no refund. Going to ring customer services for the 3rd time wish me luck.!!0

I was told today the issue is 'under investigation', i must admit i do feel sorry for the staff on the phones, its so obvious they've been told what they're allowed and not allowed to say. I said I knew other people were waiting for refunds and she just changed the subject, i dont hold much hope of getting it tomorrow either tbh, its soo annoying!!!0

In the first e-mail we sent you, we mentioned there was an error in the price at the time that you placed your order, and as a result we had to cancel this item. We fully appreciate why you have taken the time to contact us again, yet we are unable to fulfil your order for 'Left 4 Dead' at £15.00.
Unfortunately, these pricing mistakes can happen and we do have the right to cancel your order and have no legal obligation to supply your order. When you place an order with us you enter into our Terms and Conditions. Our Terms and Conditions, as quoted below, have been complied with and state:
"If, by mistake, we have under priced a product, we will not be liable to supply that product to you at the stated price, provided that we notify you before we dispatch the product to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the product at that price. If you decide not to order the product, we will give you a full refund on any amount already paid for that product in accordance with our refund policy in section 6 below."
It may come to your attention that you have been charged for the game primarily and other customers managed to receive their orders. Orders which were placed before this error was reported have gone through our dispatch process and were sent to the customer. As soon as the mistake was brought to our attention, we corrected the price on the website and made our customers aware that any outstanding orders wouldn't be fulfilled. We can confirm that a full refund has been issued back to your account if you had been charged for the order and might take up to 10 working days for the refund to appear in your account

I have just rung my credit card as instructed by tesco. Tesco insisted a rufund had been made on 1/12/09 however credit card have checked and no such refund is pending or on my account. They have started a dispute with tesco for their £15 on the "goods not received" clause. will probably ring tesco too to see if they will do anything!0

Well ......
Just been on to Tesco customerService for the 4th time.
This time they admit that the refunds had not been processed, that they had been suspended in the tesco banking system and will now be in our accounts in the next 3 working days, he apologised and waffled but didnt offer anything but once i started asking for compensation eventually offered me £10 towards telephone calls and time spent!!!!
I now wait to see if i get this money and also my long awaited refund.
We shall see.......0
