No refund here either...
Update... just got off the phone to Tesco Entertainment. I was as pleasant as pie (after all, it isn't the poor rep's fault) and enquired about my order. Got told it's cancelled (knew that), got told it's been refunded (it hasn't), got told any delay is the bank's fault! Asked why they took payment when the confirmation email says they wouldn't until despatch...reply: it was a system error! When I explained that would never stand up in court, the rep agreed with me! He also agreed that I really should have had the product that I entered into a contract to buy (as Tesco had taken payment). He said the CS reps weren't happy about this issue as that's all they're dealing with at the moment and he agreed with me that Tesco should have taken the hit and shipped the game!
I explained that I considered Tesco had stolen my money... he agreed! I then asked what would happen about the missing money as my account interest is calculated daily and they had possession of £15 of mine that wasn't earning interest (yes, I know the interest would be miniscule!). He said... as a personal gesture from him for being polite about it all... he would credit another £5 to my card!
If I keep phoning, do you think I'll get enough to buy the game at full price??? LOL

Define "clearly a misprice". When I raised the point with Tesco they couldn't. For example a product priced much lower than it's RRP, did that make the Sainsburys price for MW2 a misprice?
What makes you conclude that no laws are broken? Have you considered them all in depth or are you an amatuer lawyer? Which law did you consider? How did you apply it? Did you take the time frames involved in the transaction into account?

A clear misprice. A brand new game retailing far below what it would normally wouldnt and not part of a special promotion. If tesco intended to sell the game at that price it would have been advertised. It was very obvious from page 1 of this thread it was a misprice.
And no its not amatuer lawyers. It is the law. Please tell me what laws have been broken? You offered to buy a game at a price. Tesco clearly state that the contract is formed at dispatch. No game has been dispatched hence no contract exists to breach. Tesco have processed refunds. Unfortunately these do tend to take longer to hit accounts.

I don't think it was a clear misprice. It was in the Xbox offers part of the website all weekend.0 -
It's not an obvious misprice, as I said above take the MW2 price into account, yes they ran adverts to get people into the store, but I've never seen an advert for Tesco Entertainment. Tesco Stores themselves sold on release Fifa 2010 for £15 under RRP.
I'm in correspondence with Tesco regarding this, so it would be silly to point out on this open forum which Act I believe is breached and why I do believe a contract does exist. I will happily bump this when I settle either way this matter, but as it's up in the air I'll not bring my points up as to give an air of hope to those who took the refund and were happy.
If you look at the Terms & Conditions, as you understand the law, you will see that many acts apply. Did a contract form? Is there an argument for either party? Can certain points of the T&C be argued? Is the point to their argument valid?
And before you say anything, I'm not an amateur.0 -

There is no argument. No contract has been formed here unless goods have been dispatched. Thats very clear.
Please make your arguments about what laws have been broken or a contract has been formed. Please remember to refer to the relevent terms and statute for backing your claims a contract was formed.:rolleyes:0
