    And you are right about it technically having to be in a physical store ( within 30 miles) and it is displayed on the poster instore.

    But Sunday started with a bit of a drama as I called Currys from the number on their website to get them to price match because as you mention if its an online price then it can only be price matched via currys by calling them. I did at 10am sharp when they opened and at first I thought i was going to get it but when the person went to talk to their supervisor I then got this snooty woman who said they only pricematched with Tesco.co.uk and not Tesco.com or any other tesco site. Had a bit of a hoohaa with her but she wouldnt budge, even when she let slip they matched tescodirect. Anyway I decided to give up with her.

    Went into town about an hour later and thought I'm gonna plead ignorant and give this a go. Got a young guy and he had a quick look online and put it through without a problem, didnt even need to ask for the 10% difference , just said £12.50 please !! I then cheekily asked could i get anouther and he said no probs , couldnt get my debit card out quick enough !!!

    Scored on both points as they shouldnt have matched online and also the policy states single units so I technically should have been refused a second copy.

    I guess if the transaction is not fully mentioned on your statement, your chances getting the game for £15 is next to Zero!

    Sorry to bring this up again but checking my online statement today tesco took the money from my account and credited the same day, the credit shows before the debit. Do you think I could chase this up with tesco or just leave it.

    I have just checked my statement. They debited the £15 from my account on the 28th of Nov and then credited me back on the 1st Dec.
    People have mentioned earlier in the thread that if they have taken payment the contract has been completed and they have to honour it but, to be honest, I'm not sure if that is correct.

    Well they took mine out and gave it back on the same day so they knew they were not going to honour it?:rolleyes:

    i have had money taken from my account and no refund to date!
    get in touch with consumer direct, they will report them to trading standards i was told that as tesco t and c states money only taken on dispatch of item, so contract broken if they actually take money instead of leaving it pending as they should have, they said they have had lots of complaints about money taken today and will be reporting this issue to trading standards, you wont get your game but it will teach tesco a lesson if trading standards get on their back

    They took the money from my account on 2 Dec... and haven't refunded it! Just tried to phone their Customer Services... get through all the automated menus and then get an engaged tone!

    Edit... just got through and was told that the money has been refunded but it may take 3 or 4 days to show with my bank. I asked about the fact that they had taken the money constitutes a binding contract. I told the advisor that I was aware that they don't have to sell me a mis-priced item but that once they had taken payment then the contract was binding.

    His reply was that due to their terms and coinditions on the website, this does not apply. See extract form Tesco Entertainment T&C below:
    If, by mistake, we have under priced a product, we will not be liable to supply that product to you at the stated price, provided that we notify you before we despatch the product to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the product at that price. If you decide not to order the product, we will give you a full refund on any amount already paid for that product in accordance with our refund policy in section 6 below.

    I questioned whether their terms and conditions over-ride the Law and the answer he gave was that they (I presume the telephone team) are not happy as they have had thousands (!) of complaints about this but the decision was taken by "higher management" after consultation with their legal team.

    I asked to speak to "higher management" - he said they don't speak to the general public! I asked to speak to a supervisor and he told me that he was a Customer Services Manager and could do nothing.

    This is all a bit odd as their confirmation email says that I won't be charged until the item is despatched!

    Guess it's Consumer Direct/Trading Standards next!

    He said he believes that the transaction for web orders is automated and wouldn't be enforceable. However, he suggested I write to Tesco Entertaiment via recorded delivery and insist the money is refunded in a reasonable time frame. He suggested 14 days.

    I then told him that the confirmation email states no payment will be taken until despatch and yet it clearly had been. He has opened a case, taken my contact details and given me a case number. It is now being passed on to Trading Standards. I don't expect to get anywhere but the process is keeping me from being bored and Tesco have annoyed me a lot recently! LOL

    On my account the refund came first, then they took the money afterwards! Strange.
