    To answer your question, it's NOT a legal fine. They don't have the power to issue fines. I'll be corrected if I'm wrong but I believe only the Police and local authorities have the power to issue parking fines. Secondly, they aren't rational people, they're scammers. No different from the nice Nigerian lawyers you hear from that have millions of pounds they want to deposit into your bank account.

    Best advice is:
    1. Don't pay.
    2. Ignore ALL letters from them, their debt collecting department and their 'solicitor'.
    3. Use the money you've saved by not paying their 'fine' on a good day out.

    If you read this thread you'll see that all their threats are just that - threats. No action will be taken against you and, even it were, they could only claim for loss of earnings and it wouldn't affect your credit rating. It would cost much more to take you to court than they'd get in compensation. It will take a few months but eventually you'll hear no more from them.

    Its NOT a valid fine. There is no legislation governing private parking tickets, and Excel do not have the statutory authority to fine anyone (only a court can do that).

    They can try and pursue the driver for their actual losses only. This throws up a few things:

    1. They don't know who the driver is. They can look up via the DVLA the registered keeper of the car, but this is not necessarily the driver, and you are under no obligation to tell them this.
    2. Their losses are the cost of the pay and display ticket, not the £60 (or whatever it is) they are attempting to extort from you.
    3. Under a recent legal ruling in the Upper Tribunal (which makes it binding on lower courts), a private parking company cannot levy charges unless they own the land, or have had proprietary rights signed over to them by the landowner, which I'm willing to bet hasn't happened here.

    So, in summary, the driver of the car owes them 60p (or whatever it is), which Excel cannot pursue them for anyway as they do not own the land.

    Ignore their scary letters, you legally owe them a few pence at best.

    you got done(oh no you didnt),on my patch, i patroll the peel centre as often as i can in my spare time, basically educating unsuspecting motorists about the scum known as,, excell parking, now listen and listen clearly,, they have no powers to fine you,no powers to issue a ticket,in a word,, no powers atall,,you are falling into the trap of worrying, this is exactly what they and other ppcs want you to do, so you will pay a fake fine,so relax,chill out,glass of wine,do some homework/research into,,parking charge notice scam(google those 4 words) and you will clearly see and then believe its a scam, so nothing can/will be done to you,,only a PENALTY charge notice is legit issued by police/traffic warden,,excell are neither,what they are is major scamsters, i was on my patch there today between 9.15am and 10am,the excell folk saw me, knew exactly what i was doing, but did not do anything, apart from the fact i am over 6ft tall and more than well built the converts i spoke with, some unsuprisingly have been caught out by this scam,,dont become one of them.now i order you to relax and read the stickies of what letters to expect,,,roxburghe and the phoney solicitor graham white,apart from being part of the scam, they incredibly are on the next desk to each other.

    We know you were thinking of 'appealing' because you have read the fake ticket and believed there is an 'appeals procedure'. The real truth is, THERE IS NOT.     You are making the mistake of thinking a PPC parasite firm is run by rational people. IT IS NOT. You are probably confusing what they do, with a claimed service of 'parking management'. IT IS NOT. It's a scam, pure and simple, and money is all they want.

    It's a mail scam, just like a phishing emailer. Do you lose sleep over those emails when they impersonate a website from eBay or your Bank? No - you chuckle and cheerfully delete those emails! So why worry about this scam just because it impersonates a PCN?

    Do you reaslise that most of us are on here because we have ignored at least one fake PCN like this? Some here have ignored DOZENS!

    I am just an ordinary wife and Mum and I didn't lose any sleep when I got one of these 4 years ago, and all the threatogram letters. In fact it made me laugh out loud when I saw the piece of rubbish on my car windscreen! I already knew about this scam from websites like this and was already posting advice. Getting one myself just made me more determined to stop anyone falling for this impersonation of authority scam and I am here most days saying the same thing to every single poster like you. Same as most of the regulars here, we hate this scam.

    Just to add the usual advice as well, to read the forum to learn more and be ready for the 'scary letters' - they are actually quite amusing! :rotfl:

    Did you think this rambling old thread was the only one about the fake PCN scam? Oh no it isn't!! :D

    You will just get the same letters we all do - and despite the 'debt collector' or 'solicitor' headings and bold lettering, threatening increasing charges, they really are very easy to ignore (as we all do!).

    All the letters can be seen as picture previews, in the permanent info 'sticky' thread near the top of the parking forum. See my signature for the words to click on, in order to take a step back and see the whole current thread list.

    One click and you see all the current threads here. Third from the top, click on 'PPC letters & threats'.

    1. Watch the Watchdog clip on there, and then

    2. scroll down to the pics of Excel's threatograms, then

    3. Play a nice game of snap with each matching templated threatogram, then

    4. Tell your friends & family about the fake PCN scam so they never pay one.

  • I received a ticket from the peel car park earlier this year & read this thread.. obiously deciding to ignore the ticket & a couple of letters that followed.

    I have just received a call to my mobile (no idea how they got my number) from excel (number displayed was a mobile number so i answered it) reminding me about my unpaid fine, asking me to pay up what is now £140.

    I said that they have no right to demand such money from me because they are not run by the council (i was put on the spot - best i could come up with). They then asserted that I owed them money and that they are part of the Brithish Parking Association... blah blah blah. I jumped onto the BPA web site while I was on the call, saying that I see that the BPA is a limited company & VAT registered, leading me to believe that they are members of a PLC-type association which is probably funded by members to use as a scare-tatic to make themselve sound more legit. They didn't like that and said they would now mark me as refusing to pay and hung up.

    I am now a little concerned....... should I be?

    I dont feel like I did myself any favours!

    concerned about getting a FAKE ticket on my patch????? ,,no chance,,,dont be ,,exspell cannot issue a fine/ticket,,so ignore,,if the phone calls continue tell them,, the debt is denied and if they call again you will report them for harassment,,say ABSOLUTELY nothing else and hang up or simply dont answer there call,exspell check this forum daily so do not give out any personal info or reply to any pms that have a low ,, thank you count,,as they may try to suck you in,,worry not about these clowns and roxburghe (zero powers ) debt collectors and/or the world famous PHONEY solicitor,,graham (i am definitely not a real solicitor) white,nothing will/can happen as a result of this,,incidentally the other rogues locally are ,, parking eye who patroll(con motorists) at aldi on newbridge lane,,pm me anytime.
