I still havent received a reply from the ICO regarding the agreement.

Studio stated in there last letter they sell on a non-advised basis so how would it be possible for me to prove that the person selling the policy did in deed give advise stating i could make claim even if i was unemployed with a bad back.

This is one of the fob offs, but still if you were not eligible you should still be entitled to your money back as it was worthless to you in the first place of when they did sell this to you.

Just as long as you have an account number you can still continue to make a reclaim.
Do you have this at all?

I would write to cancel this and tell them you do not require the PPI (if you don't need this that is) and request they refund you with your reasons you have for being mis sold.

Below is the link to reclaiming with the guidelines, with template letters, you can use the templates if you want to, and also check the checklist for the mis selling reasons in case any of them applies to you as well.
They have 8 weeks in full to respond, keep at them, and post by recorded delivery for your proof of posting.

Then let me know what their decision is when you receive this and we shall take it from there to the next step if they do not resolve this in your favour.;)

Hope this helps, and they may suddenly send you the agreement you have been requesting back with the letter.

    Good luck.

The PPI was cancelled early 2008 its just in the last few months i was made aware that i may be able to reclaim the premiums back due to me being unemployed with a back problem at the time of sale.

I have asked them to refund and after being knocked back i then asked them to reconsider there decision but was knocked back again.

Sorry just re-read your first post again.

Have they actually sent you a final decision which confirmed they will no longer look into this?

If not then write back and ask them to reconsider your request of refund with your reasons.

If this was the final letter, did they give you any details/leaflets of the Financial ombudsman service?

Until you receive the letter where they say its the final one, keep at them, if they still do not resolve in your favour then you can ask the Financial ombudsman service (FOS) to investigate this for you.;)

  • It sounds like what they have said to me.

They denied that I had asked for my statements despite already sending them to me previously. I opened the account in Nov 2003 and after using the account for two years I noticed they started charging PPI. When I querried this they said I had alledgedy asked for it to be added when I placed a written order. I have never seen any paperwork for the PPI or remember asking for it, also their is no box to tick on any written order forms. Just for investagating purposes I have emailed them to ask how I would add PPI onto my account so I have more ammo to fire at them.

I will be ringing them as they are still refusing to play ball.

    Thanks di3004,
I think i will send of another reconsider letter as they never put in the last knock back that it was there final responce but they did give a ombudsman leaflet.

    I will state
1; i was unemployed when the policy was sold
    2; i had a pre-existan back injury
3; the salesperson did advise that i would be covered.

Anything else you think i could mention.

    Good for you.
    Also add:
The policy is worthless to you (or was if this if the finance is no longer active).
And your out of pocket due to this policy where you would not have been eligible to make a claim anyway, because you was unemployed in the first place.

    Hope this helps.
Fingers crossed, please keep us posted on this, cheers.;)

  • Dont know if this is of any use to you, I went through the small print and the cover and if you miss 3 payments the policy is void.

    9. When does the cover end?

9.3 On the date you have missed 3 payments.
