Dont know if this is of any use to you, I went through the small print and the cover and if you miss 3 payments the policy is void.

    9. When does the cover end?

9.3 On the date you have missed 3 payments.

The address to write to is-

    Express Gifts Ltd
    Express House
    Clayton Business Park
    Accrington
    Lancs
    BB5 5JY

    Thanks Diddles1978,
It may well come in handy, good luck with your claim and please post what they say when you call them later.
  • Hi
Just to jump in on your post but I'm having very similar problems with Ace (also part of studio & express gifts).
I have had one rejection letter off them stating that it was a non advised sale. I wrote back in early dec asking for a copy of the order form (on which I supposedly ticked the PPI req box!) and still haven't had a response.
Is my next step to try the ICO or to write again to Ace asking for it and giving them a further 12 days? (They def had the first letter - was tracked!)
Alternatively should I write to Ace and say that as they haven't provided the order form I am still disputing it and ask for the amount back before I threaten FOS? (They have told me I can't refer to them as they were not regulated when the policy taken out, but I understand that the FOS are sometimes taking these cases on??? )

Sorry for all the questions and information given, but if there are a few of us struggling with the same company then if we can all get the same letters etc to them they might even bother to respond!!!

    Hi there.;)

did you enclose a £1 postal order or cheque payment when you requested for your agreement?
If you have and the 12 days have passed, I would chase them up with a quick phone call, tell them you will discreetly give them a further week as from your phone call to receive this, or if you want to call the ICO and see what they advice.

If you did not enclose a payment then write a further letter to request for this making them aware you have also enclose the required payment, and expect to receive this by 12 days, post by recorded delivery.

However, if you still have the account number you can still continue to write to reclaim on this anyway, but if the FOS are unable to take these on then make sure with them first, then you could always start again with this but with the actual insurer of who would be making the payouts if you did ever have to make a claim.

You may possibly receive a fob response where they may say they were not responsible, but its another direction where many have us have gone this direction where the FOS will or should be able to investigate as these were highly to have been covered by the FSA.

    Keep at them, good luck.
    Please keep us posted.;)

  • Thanks Di,
I included the £1 cheque, can't see that its been cashed, but then the never charged for the statements either (for the reclaimed late charges!)
I'm not sure how to find out the insurer? (My mum was using this account in my name - I opened it years ago and forgot about it!) We have no details at all for the PPI other than i saw it when I requested the statements. I wasn't working at the time (was a student) which is one of my reasons for mis-claim!

Thanks, any advice much appreciated xx

  • Was it the £20 late payment charge you reclaimed, and what did you do to get the charges back?
  • Hi

it was a combination of £20 and £15 late fees. Weirdly they INCREASED their late fees in 2006, when everyone decreased theirs!!!!

Anyway, I just followed the template letters on here for reclaiming the credit card charges (sorry don't know how to make a link!) but its under the reclaim £1000's tab at the top. To be fair to Ace on this, I sent one letter requesting the statements (which they sent without charge and very quickly) and then wrote again requesting the full amount (plus interest) be paid back. They didn't argue or offer any partial refunds, just wrote back and said that as a gesture of goodwill they would refund the full amount, which they did for the next statement!!!
was about £370 and took me about a month - definitely go for it if you have any!!! I've gone back at them for the difference of the 8% interest and the contractual interest of 24% that they have applied so will let you know how I get on!!

If you need any help, give anyone on the reclaiming credit charges forum or myself a shout, it is the easiest process, much easier than PPI!!!!:rotfl:

    Your welcome.;)

    Give them a ring.
Did you post your agreement request by recorded delivery?
If so check out this on the tracking part of the Royal mail, if this proves to have been delivered, I would ring them to make them aware you know they received the request and ask them what are they doing about it.

Ask at the same time the name and details of the Insurer, or ask if they can send you the policy of this through the post.
If you feel better writing to them instead of ringing them, then do this if you want to.;)

    Good luck XX

  • Hoorah I got back my £150 PPI and £75 default charges today!

I phoned them and asked for a copy of when I suposedly signed up for PPI, which they havent because I never did. So I said that will look good with my claim against you which is at the FOS (I rang on the off chance with the idea of going to FOS this monday) The lady in the insurance got all uppity with me and suddenly the sound quality of the phone line improved. So I said dont bother recording this because I have and will be using as evidence in my case. Then next day a letter saying both of my claims have been refunded.

They are just a bunch of bullies.,

Excellent!! Well done!! :T Hope I have the same success! I just posted them a letter on Friday asking for my ppi back as I never signed up for it either it was automatically put on to my account when it was opened and as I was young at the time and knew little about PPI I assumed it was part of the agreement. When I asked them what it was they were chargin me for I was told it was cover if I was ever sick and needed help to pay my account and I had to have it because I was in temporary employment... anyways once I sort the PPI out I'm gonna hound them for the late payment charges and missed payment charges. My £100 quid order turned into £400 odd at one point because they piled their charges on every month because payments were few day late because of when I got my wages! lol maybe I should've tried to claim them first but hey ho my first happy letter to them is on its way and I ant giving in without a fight :D
