Working..... pay for holiday abroad in x months time... few weeks later lose job... begin claim benefits...
Plausible? Of course. Just because your on benefits does it mean you should give up your holiday?0 -
I hope you consider your speedy return just incase that job interview looms
a speedy return is impossible unfortunately. when i go home i have to leave in the morning and i dont get back until around 5pm. i cant leave to go home later in the day coz i would miss the last bus(i get several buses). so if i was contacted at midday on a monday the earliest i could be home for is 5pm tuesday. so it would be wednesday at the earliest before i could act on the job. it would only be a job i had applied for myself because the jobcentre never phone me.0 -

utter gibberish my friend, ever read james joyce's 'finnegans wake'?
I shall take that as a no, you do not understand the rules of statutory interpretation. Perhaps when you take your case of the HofL you could suggest to them that they are talking utter gibberish? :rotfl:Gone ... or have I?0 -

Comradeguevara, you miss the point.
These are the people who hear appeals and review decisions. It is a quasi-judicial function for which they have access to legal advice, if they are not lawyers themselves. They wrote the Guidance notes for JSA administrators and practioners. I was suggesting that if you feel that their Guidance Notes don't carry as much weight as a lay-person's interpretation of the legislation then you might be deluding yourself.
In my field, the Guidance Notes attached to particular legislation and directives carry considerable weight and assist judges in coming to a view about what the legislators intended. They carry EVEN MORE weight where they are published and accessible on line to the general public.
Because of the Freedom of Information Act, you can now access and read Guidance Notes. It might be an idea to have a look at them - you will be better prepared to argue the case with the local JSA person.0 -

if someone asked how ronnie biggs got all his money and i said he got it by robbing a train. would i be doing wrong by mentioning the act of robbing a train?
They afford it by defrauding the system. There was no need to mention that, unless you are suggesting that is what the OP should do? We all know that you have suggested this before, don't we?
Looks like Abuse need to be made aware of your suggestions again donnajunkie.Gone ... or have I?0 -

Exactly I should imagine this is happening all over the country with people having booked and paid for their holidays well in advance of redundancy and unemployment.
I wonder at the cast iron industries some people must work in on this board.
Also most unemployed people wanting employment do still job seek while on holiday. With laptops and the internet this is no problem. Lots of jobs give interview dates in advance and it is only a small sector that call to interview immediately.0 -
comradeguevara wrote: »thats the whole point, you are not actively seeking for that period and you have disclosed that to the job centre, as reqd. you are 'treated' as actively seeking for purposes of payment of benefit as allowed by the regs.
read and accept the whole paragraph, not just the sentence you want..!!
You might not be 'actively seeking employment' whilst you are on holiday in the UK but if you expect to keep your claim on the go whilst you are on that holiday the agreement is that you should be available IF a job interview were to come up...
Nobody is disputing that you can't go on holiday..just that if you want to keep your claim open you keep your side of the agreement...and that is to be available should any job interview crop up...simples!
If you know that this will be difficult to do then sign off until you get back.0 -
One of the conditions of receiving JSA is that you are in Great Britain or Northern Ireland.0
