You ask whether the Guidance Notes can have more force than the actual legislation.

Let's just say that the Guidance Notes are written by:

Jobseekers Allowance & Decision Making Appeals Team
Level 4, Rockingham House, West Street, Sheffield S1 4ER

Perhaps you could find their phone number and ask them your question.
the decision making appeals team did not draft the law, nor are they, i suspect, legal professionals. looks like i may have to go trail blazing again.

Are you spouting your fraudulent rubbish again donnajunkie?

lol. no i am being very careful. i dont want to get reported again by the prim and proper brigade. people here are wondering how unemployed people afford to go abroad. from my experience this is how alot of people do it. i clearly acknowledge it is technically illegal and i am not advising people to do it. so i have not done anything wrong by mentioning what some people do.
by the way incase anyone is wondering i have never done it. my fellwalking trips are very cheap. i stay at youth hostels and i get there for free as i qualify for a bus pass.

But if you are 'actively seeking work' and continue to claim these things should be taken into consideration before you go on holiday!

thats the whole point, you are not actively seeking for that period and you have disclosed that to the job centre, as reqd. you are 'treated' as actively seeking for purposes of payment of benefit as allowed by the regs.

thanks to all who have made positive, constructive contributions.

The law is open to interpretation. Whilst the literal interpretation of your carefully selected words may support your view, the statute as a whole does not. You may wish to research the different rules of interpretation, as your current stance makes me assume you do not currently hold this knowledge.

By all means go ahead and test the DWP's interpretation of the law. I would like to see how far you get. :T

You seem unwilling to comment on my point re statutory interpretation?

Then don't expect any benefits (JSA) for that period then :o

i suggest you need to read my post again. i said i mentoined it because people were wondering how unemployed people manage to afford a holiday abroad. that is how alot of them afford it. now people know how they afford it and no longer need to wonder how.
if someone asked how ronnie biggs got all his money and i said he got it by robbing a train. would i be doing wrong by mentioning the act of robbing a train?

read and accept the whole paragraph, not just the sentence you want..!!
