So very pleased to hear it went OK, in the end! Just relax now, take a step back. I can only imagine how awful things must have been for you. I thought I was going to lose my girl to Leukaemia a couple of years back, and that was bad enough. I still have her and cherish every moment. That is all you can do know, remember all the wonderful times you shared with your son, and cherish every moment of your other children's lives. Hopefully now you can begin to live again. I send you my very best wishes and a great big hug.

Thank you guys, You're so true Fred, If i learnt anything out of the last few months its how precious life is, our kids are precious gifts on loan to us for how long noone knows hopefully til after our time but sadly not always. Makes you rethink all important in your life. Money debts and things are soo worrying and damage so many lives, mine included, but i'd give everything to have my boy back and not have gone through what me and my kids have. We all miss him terribly, whoever said it gets easier is talking bull, guess one day we'll learn to cope hey. Anyway treasure your precious gifts and your loved ones close, tell them you love them as much as you can, sometimes its the only thing you have left. xxxxxxxxx
  • Hello again guys, its been a while since i posted on here but i think i might need your help again please.
A lot has happened since i last posted so be patient please.I,ve been struggling with depression since my son died and still am, i was referred to psychiatrict nurse for coucilling and diagnosed with post traumatic stress disorder in aug 2011, which isnt really surprising after everything thats happened, work finally finished me in dec 2011 but i managed to get a new job in feb 2012 which i really enjoy. I was also diagnosed with fibromyalgia in jan 2012.
Anyway I've been off work again with severe depression (they have been amazingly supportive as has my doctor) and with xmas looming its the time of yr i hate for obvious reasons. Anyway i was off in the summer on nil pay and got myself in a major pickle again with debts, they finally enforced the eviction notice thats been over my head the last few yrs (debt was cleared in br 2010 but order still stood) and i took out some payday loans to try and help but this just made things worse. I managed to find a private rent house and moved into it a month ago and after nearly 4 yrs im managing to finally get more sleep, the move was the best thing i could have done.I,m seeing my doctor again next week and am gonna ask to be referred back to pysych nurse to continue councilling as i really need some help coping.
Anyway my problem is that i now have rent/ct arrears chasing me and 5 payday loans i cant pay debts are prob about 5000 atm but will rise with interest from the loans and im worried sick again that i may have to go bankrupt again as i just dont have enough money to pay them all. I love my new job and am really trying to sort my life out now, please dont judge me too hard for having more debt problems, if you read my full story you will understand why, but i now feel i need to sort my life out once and for all, i know not to make some of the mistakes i have but i need some help as to what to do now please
  • Hi. I have to confess to not having read the previous 6 pages. What's happened with the house? Was it mortgaged or rented? You say the eviction order was enforced? Also that you owe rent and council tax? Is this for an old property or the property you currently live in or what?
First place I'd start is probably by doing an uptodate SOA from makesenseofcards website to see how the land lies and take it from there.
Firstly I'd want to make sure that, on paper at least without the debts hanging over you that you could manage your finances and that your essential outgoings ie rent, council tax, water etc are less than your income. That's the first thing.
Then you can assess what your plan of action is going to be - whether it be a dmp or whether something a bit more drastic is required.
Also have a think about where the debt has come from - has it come from just ignoring bills and interest and charges, loss of job, illness, over spending to compensate for things or what? Not to criticise you or for you to beat yourself up but clearly if something is going wrong you need to know what has caused it because you really don't want to be stuck in the same situation again. Also if you know what the triggers are/likely outcomes then you can get help for them before it gets to be such a big deal in the future.
    Best of Luck

  • Also the usual advice is to get a new basic bank account set up as a priority so the payday loans people can't rinse your account - try Co-op or barclays (although co-op may not be able to help since you are already bankrupt but worth a try anyway). Once you have got a new bank account you need to try and get wages/benefits transferred to your new account and then you can work on trying to straighten yourself out/start payment plans etc.

the rent/ct arrears of from the house i've just moved out of,they were going to enforce the order then i went to court and had it suspended, i moved out to get a fresh start without hving order over my head all the time

Also if you know what the triggers are/likely outcomes then you can get help for them before it gets to be such a big deal in the future. the triggers are clear in my earlier post, due to the loss of my son dec 24th 2008, i am returning to work in jan after being off sometime with depression on ssp only, hence the struggle the last few months
Also the usual advice is to get a new basic bank account set up as a priority so the payday loans people can't rinse your account - try Co-op or barclays (although co-op may not be able to help since you are already bankrupt bankruptcy discharged in aug 2010, am with co-op at the moment but worth a try anyway). • Its alright I skimmed a few posts. I just didn't want to have to read the entire thread for the important details re rent etc. The rent is now longer so important as it relates to a previous property so hopefully can be included in a payment plan etc without you having to worry about loosing your house etc.
I think you will probably need a new bank account due to having payday loans associated with that one. It's a pain you already have the co-op one and will have to change away from it. Have you tried Barclays?
Another option may be to get a low cost loan from somewhere like a credit union that you can afford and pay them back rather than all the individual payday loans companies although this will only work if you can afford the loan you take out. If you do an SOA you will see if this is potentially a viable solution for you.
I'm not sure on the repurcssions of going bankrupt twice within a short period of time. Perhaps someone more knowledgeable will know?
Anyway best of luck whether you decide to go down the bankruptcy route again or whether you go for a dmp or other. Given the amount you owe you may possibly be suitable for a DRO but given you already have one bankruptcy I'm not 100% sure if this would be open to you.
Start with the SOA. and good luck on getting back on the waggon :)

  • Re BRO's etc it says :
'Being bankrupt for a second time in six years is also a matter of conduct to be considered but is not, in itself, sufficient reason to apply for a BRO'.
Taken from the link here: http://www.bis.gov.uk/insolvency/personal-insolvency/bros-and-brus
My only concern (and I've no idea whether this would be shared by the OR or not) would be whether you are likely to get into this situation again and whether you are receiving the right help and support, if only because running up debts and not being able to pay them is a) costly and b) must be stressful and not in anybodys best interests, if you see what I mean.
I just hope you get the right help and support.
