    under what circumstances would benefit be stopped if the ib50 was not completed?
    and what kind of incapacity would you need to have that if you failed to complete your ib50 you would still get asked to attend an assessment?

    Stazi has answered this for me, but I should have said it would not be stopped if it related to a mental health problem.

    It won't matter if they stop the OP's IB on the 24th Dec because by then the pension will have started.

    Yes, its kind of daft sending it in the first place isn't it. Thanks to everybody :) - I like to double check everything with the benefit people because it's so easy to do the wrong thing without realising it eh.
    Not a mental health thing, no.
    And I was wary in case they stopped it right now and left me without anything, that's why I asked on here instead of just phoning them right away.

    The time limit for returning an IB50 has always been 6 weeks. As I said earlier, unless the customer has a mental health incapacity, IB/IS is automatically disallowed if the IB50 is not returned by the 6 week time limit. Also, IB/IS & ESA can be disallowed if a customer fails to attend, or fails to submit to a medical examination, without good cause.

    After 4 weeks, ATOS send a reminder letter giving a further 2 weeks to return the questionaire, making 6 weeks in total.

    Odd, they threaten to stop my benefits when I didn't fill in that form on time, they sent out a reminder before the final date reminding me again they would stop benefits, and I fell into the mental health problem side...

    I think they must know my age and birthday - otherwise it would be an odd coincidence that its the day after I'm 60. Either way, I will phone them and explain , ty all who helped :)

    What if the OP had been male, all circumstances very similar, but instead of due to receive State Pension...he is due to receive Pension Credit.....

    It seems petty to try and stop a benefit days before he is due to come off it, and on to Pension Credit.

    Well, petty is what they DO isnt it ! I have now had a letter saying that my pension will start on dec 28th. Why, I don't know. But the IB will def stop on the 24th, so where does that leave me for the days in between ? Or am I being petty now ?

    Sorry, mardatha DWP/JCP only apply the relevant laws- they don't make them.

    IB stops one day before 60/65, and State Pension starts on the first Monday on or after age 60/65.

    Before 1995, IB was paid upto the day before State Pension started- so there was no break - but the law was changed.
