  • Hi ditto ditto ditto Mayur could not believe how easy it was to get my money back I done the exact same procedure as you even the same amount for court costs and received £1340 so chuffed went on a paid holiday!!!!!!

    Barclays will send you all your charge information over the past six years (or longer if required) for free if you write to the address detailed on the consumer action group website.

    So yes, he was fobbing you off!

    I have just found out about the recaliming of bank charges and mine are pretty astronomical. However, I seem to have slipped at the first hurdle. My bank, cooperative (aka Smile :-()are asking that I pay £10.00 for every statement over a year old. This would cost me somewhere in the regions of £600.00. I don't get paper statemenets (on-line account) so I don't know what to do.

    Any suggestions?

    Yes, go to the consumer action group website where it details how to get all the information you need from your bank for £10 under a data protection act disclosure request.

    Try the FAQ section first.

    I blogged yesterday saying that Smile were going to charge me £10 per statement for the last six years. I went back and told them this was unlawful and that I was entitled to the records and this is what I got back today...

    I'm really sorry you're not happy about the charges we apply for copies of statements. I'll explain the process to you and why we do charge for this service.

    We don't deny access to your bank statements, this is against FSA regulations we voluntarily subscribe to. As smile is an internet only bank (not your normal High Street bank with online access) to save costs and pass on our savings to you with great products, we supply your bank statements online for 12 months.

    This gives you upto 12 months to print them off if you require copies, before they're archived onto Microfiche for storage for as many years as we're required to keep them.

    Once they've been archived, there are costs involved to find the statement from where it's been stored, print it out and to post it to you. This is why we charge you a fee to cover our costs of supplying an additional service.

    I hope this explains why we do what we do. If you need any copies, please let me know and I'll order them for you. Please also confirm your current address, older statements may have an old address on them if you've moved house whilst your account has been open.

    FSA regulations we voluntarily subscribe to.

    What!!!??! The FSA regulations are just that - regulations - no bank can choose to abide by them or not abide by them. The choice isn't theirs.

    They really do think that they are above the law.

    What you need to do is ask for a list of charges, with amounts and dates. That is covered by the DPA and the maximum they can charge is £10 for the lot.

    Bank statements are a different kettle of fish - but then you don't need the statements - just a list of charges and dates.

    If they are in any doubt remind them of the LloydsTSB case in which the judge clearly stated that bank statement information is personal data and therefore covered by the DPA.

    Thanks for that. I did think it was a bit cheeky that somehow an explanation of why they were chargin would somehow put my gas at a peep! (that's make you shut-up for anyone who's not Scottish)

    I have written again mentioning the data protection act so I'll see what comes of that. Maybe I'll get another patronising "explanation" but maybe they'll take my request more seriously.

    I reckon halifax have charged me a good £200 ish over last 4 years.

    they have also refunded a few as good will gestures over the years too, will this affect claiming the others back?

    same question as wizard3891... I've been with Barclays for 20 odd years (I know, I can't believe it either)... since having kids, we have gone over overdraft limits etc and have been charged accordingly. The last few have been refunded as "goodwill gestures"... does this mean I can't claim back the ones before these?

  • My understanding is you can only claim back for the last 6 years, your 'out of time' with anything earlier than this.
