    On the 9th Nov you said you were going to go to CAB about this. Out of interest, what have CAB said/done?

    I'm interested, as we're considering buying a warranty to cover DH's car.
    I try not to get too stressed out on the forum. I won't argue, i'll just leave a thread if you don't like what I say. :)

    My local CAB are closed this week to re-locate, and I'm not able to get to another one nearby as I have no car (spot the irony? Lol).

    Good luck with it, the servicing thing will be OK as the requirement for a VAT registered garage only starts when you take the policy. It must have been serviced in the year prior to the policy but there is no requirement for that to be done by a VAT registered garage.

    On the actual fault, if I was their engineer I’d argue….

    Either:

    The bearing wore out, failed and knocked the seal out and allowed 5th gear to move so some teeth got knocked off

    Or:

    Fifth gear failed, ground up bits got into the bearing and wore it out, then it failed and knocked the seal out.

    In both cases it wouldn’t have been a sudden thing, it would have been noticeable for days if not weeks, the noise would have been horrendous and the claim shouldn’t be paid because the car was driven whilst damaged. With the implication that the fault was there before the policy was taken out.
  • The last service was done on the 31st July this year and was a full service including cambelt and water pump change, as well as brake fluid flush.
    It also had an MOT done on 31st September this year.
    Neither of the garages reported any issues, and I would expect one of them to notice if it was making the noise described above.
    It's easy to say what you think is the issue without having seen or heard the car, but the FACT is, the main shaft bearing FAILED and the resulting faluire caused the oil to leak, and the rest of the damage was caused as a result. I took the car to the nearest garage as soon as I realised a problem, and now I have to justify my actions to someone on the phone who has no intention of helping, and has changed their stance on the claim twice in 3 days.
    I'm not allowed to cancel and I can't EVER claim because of the service history.
    Not the best way to spend money on a car.

    I'm not saying what I think the issue is, I'm saying what I would argue if I was the WD engineer.

    The service was 3 months before you took out the policy, a gearbox fault could well have developed in that time. The MOT would be unlikely to pick up a gearbox fault as it's just first & reverse slow on and off the ramp.

    The service history shouldn't stop future claims as the VAT registration requirement only starts when you take out the policy, it doesn't apply to services done before.
  • All this week i have been waiting for an invoice from the last garage to service my car, and due to him being busy and postal problems, it is expected to arrive at home today.
    HOWEVER...
    I have just this min had a voicemail message from warranty Direct...
    The day the car went into the garage i was told the gearbox was a FW&T item, so i asked for a refund and was declined because i had 'tried' to make a claim.
    Well now they have decided to inform me by voicemail that they have cancelled my policy and are refunding me the money!!
    I get the feeling that they were in a position where they would have to pay out, and have decided that refunding me is a better option than paying out for the work on my car.
    NOT IMPRESSED.
    Any ideas on what my next move should be?

    My guess is your next move is to take the refund, and put it towards the repairs to your car.
    I try not to get too stressed out on the forum. I won't argue, i'll just leave a thread if you don't like what I say. :)

    Go through their complaints procedure, get written confirmation that you have exhausted all possibilities with them and lodge a complaint with the insurance regulator.
