loancheck/solicitors claiming ppi

Yes we have today agreed with the Solicitors not to pursue this to court with them. We would have to state basically that we were sold the PPI with a gun to our head. This was not the case we were told that the loan would probably not be approved unless we had the PPI or BLRI as it is called. This is was the base of the case in which they could make the agreement unenforceable. This would have made the claim over £5000 so we would have been insured under the CFA and AEI.
As we are not prepared to go along the lines that they need for it to stand a good chance in court we have been released from the agreement. We did not feel it was right to lie in court and also to be cross examined by the lenders Solicitors, not something I was looking forward to:eek:.
Anyway it has today gone off to the FOS so we are happy with that. Also found another small loan that had PPI so that is also going along to the FOS as well.
So all in all am happy with the outcome. How is yours coming along Marshallka?
Am still waiting to hear back from the legal complaints service. That should be soon.
My "complaint" is still ongoing. They wrote to us last week saying they would be in touch in a "few days" so should expect to hear from them this week. I don't think they will cave though now without a fight but I will give them one.
Just have to wait and see I guess.0 -

Of my 2 cases one ended as I couldn't attend a meeting with no costs to me, the other is ongoing with the same solicitors.
I've received a letter today that shows their new rates and that they've changed to LLP status.
Previously I've been assured that should I win they will attempt to get all their fees from the other side, and should I lose there will be nothing to pay.0 -

Yes they are saying that they converted to Limited Liability Partnership in April this year. Apparently this new form of legal entity was introduced in 2000 and the legislation was designed for a partnership that wished to expand it's business and take advantage of the exciting opportunities offered by the legal services act 2007 which comes fully into force in 2011.
They say the way they work etc will not change.
Re the costs, in the other letter that details their new rates, they state that it does not effect the funding arrangement with have with them, so I take that to mean they will still attempt to get their (higher) fees from the other side.0 -

Hello everyone,
This is a cross post in case i put the other in a wrong thread!
My husband and i have various PPI claims being delt with by Dawson Hart solicitors, after being introduced to Peter ( Protected Investments and Loancheck) on this site three years ago.
My story is similar to the other horrendous ones i`ve been reading this morning :mad:
Basically after three years we are waiting for a cheque from Dawson Hart regarding our out of court settlement with Welcome Finance and they have agreed to waiver all the costs not covered by Loancheck etc. However i have received letters today saying that they are unable to continue with our other claims and are going to terminate the CFA`s due to the claims being under £5,000 and having a less than 50% chance of success.
From what i can gather (as i`m really confused by all the terminology!) these claims are nearing their limitations dates now (July August) and i feel like we have been strung along for three years and they are now washing their hands of us!
Although Dawsons are prepared to fight this for us if we pay private fees of at least £10,000 - leaving us seriously out of pocket!!!!!
What should my next steps be? Could anyone point me in the right direction? Or should i just accept defeat?0 -
I won`t be accepting defeat and will bump this up in the forum`til i find out how to get the Loancheck folk and their cronies to answer for their actions!!!
Three years of crap and a mountain of letters and paperwork written in lingo i can`t understand from D.H for nowt!!!
Anyone know if Petermb still posts on here????? The man that came round from loancheck after we had already signed loads of contracts for P.I told us he had died of a heartattack.....? :eek:0
