  • I think that solicitors should act with independence and integrity at all times acting fearlessly and only in the best interests of their client, avoiding conflicts of interest and over reliance on limited sources of work and not be tempted to allow the interests of others to influence their conduct or the running of their practice.

    I don't know anything about the detail of what may have happened in the cases referred to or why they are not being progressed but there is clearly room for all sorts of principles to be forgotten where there is the lure of easy money - whether that is the customer tempted by what seems like an easy, risk free process and others in the process are keen to get their snouts in the trough.

    Well this is the Loancheck thread and i wondered if you had a complaint with them or a solicitor? I am just glad that i pulled out reading from posts on here because i would have been doing my head in now if i was led to believe that i could make a claim for PPI etc and then get let down. It must be terrible for some of the genuine claimers don't you think. Also people are reporting they may be at risk of being charged fees.

    Did Loancheck-online (the US Loancheck) ever trade. It says coming soon on the net but there is a donations bit that takes Paypal.

    Don't think that this is actually to do with the UK business's mentioned here but it is a loancheck company???

    Yes I noticed that Marshallka, surely they are not going to trade. If they do does that mean the investors in the UK Loancheck can recoup some of their costs?

    I don't know Maxdp but seems that it is not trading now although there is a bit that asks for donations and if you click on the paypal it actually takes you to login page of paypal. I would have thought this would have been switched off until the business is up and running. Just seems strange. Perhaps after logging in you cannot donate?? Also don't think its actually to do with the UK business BUT it is definately a loancheck company.

    Have heard back from the Legal Complaints service associated with the SRA concerning my Solicitor who has not contacted me even after many phone calls and formal letters.

    I was advised to take the PPI complaint to the FOS to see if they can help even though it is 6 years in April since the Loan was taken out.

    I was told that it would not be "adviseable" for the Solicitors to try to charge me in any way for any fees to date. I explained the agreement and that if I back out of the agreement we would be charged. He said he was sure that would not stand. They are looking into.
    Failure to respond to communication from the client.
    Failure to progress the case for the last 15 months.
    Failure to advise in the first instance that FOS can help without charge.
    Negligence because the complaint is effectively nearly time barred.

    Have now to wait for correspondence from them further as to the Solicitors response. He was not expecting a fast response and could not guarantee all paperwork would be returned pronto.

    Have just contacted FOS who are willing to help out on this. Have given me a complaint No and are going to contact LLOYDS. Although it is nearly 6 years since the loan was re financed it was less than 3 years that we became aware of the problem.

    This is really good news and am really pleased.

    Yes we have today agreed with the Solicitors not to pursue this to court with them. We would have to state basically that we were sold the PPI with a gun to our head. This was not the case we were told that the loan would probably not be approved unless we had the PPI or BLRI as it is called. This is was the base of the case in which they could make the agreement unenforceable. This would have made the claim over £5000 so we would have been insured under the CFA and AEI.

    As we are not prepared to go along the lines that they need for it to stand a good chance in court we have been released from the agreement. We did not feel it was right to lie in court and also to be cross examined by the lenders Solicitors, not something I was looking forward to:eek:.

    Anyway it has today gone off to the FOS so we are happy with that. Also found another small loan that had PPI so that is also going along to the FOS as well.

    So all in all am happy with the outcome. How is yours coming along Marshallka?

    Am still waiting to hear back from the legal complaints service. That should be soon.
