PPI claim against Welcome Underwriters

urbangypsy wrote: »HI I had a ppi claim rejected by FOS saying that WFS were not regulated at the time the Loan/PPI was taken out which was Jan 2004. After months and months of research I came across a screen print from WFS database which clearly showed they were in fact regulated by GISC. I then resubmitted my claim with this evidence and have just been paid out almost £2000.
Incidently even after all this, the FOS told a colleague of mine only last week that WFS were not regulated in Jan 2004 so they are clearly STILL giving out wrong information.
Hope this helps some of you
Best of luck0 -

Aviva were formerly known as Norwich union when I took the loan out and the Broker was Direct group. I feel totally stuck. Can you and Di maybe explain where to go with this as not so sure what you mean by the print offs? Having a blonde moment! The way I see it the FOS will shortly send me all the paperwork with a letter saying Aviva wont payout and Welcome were not regulated. Thats not me being downbeat as Im ever the optimist!!! Its just obvious from the way it is going and I sure as hell want to win this!!!:cool:0 -

well they certainly know about it as they (FOS) negotiated with WFS for my payout,
It mustnt be common knowledge though as they gave wrong info to a colleague only last week. I have phoned and told them but not confident about them. Ive tried my best!0 -
I cant believe that some at the FOS are still getting it wrong with regards to when Welcome were regulated, how many consumers dont post on a forum and cant be put right? Or have access to a computer to do research?DS1 12/10/04

Forgot to say, the gent said it would be helpful if we could send copies of the statements of the mortgage letters of arrears and bank statements and if the GP will provide info of hubby's depression etc, things like that and that we are under the CCCS as well, they want their details.
We have all these to send, hubby due to GP check up as well and he is a great GP, so hopefully this should all help, fingers crossed, although not going to hold any hopes on it.
Basically hubby explained the situation, that we have been from pillar to post and not knowing where to turn, due to being told go here and go there, he also told him that we have "now recently" found some info in regards of underwriters etc, and we did not have any of this evidence the last time we tried.
The gent did not look into our details on the system, but said they get lots of these complaints and phone calls with many with the same problems, and within good reason they can be looked at again, not always easy but worth trying.
Hubby said "this is a brand new complaint" explained the last one, and the guy said to him personally that should be okay, but see what they say on Monday, if we don't hear anything by the afternoon, he said to ring back up then.
Keep going with this Di youre doing great.x Hope they can get this looked at on Monday and take your circumstances into account, sure they will and the FOS will do all they can especially now firms have been told to deal with complaints properly!:A

If this complaint gets through cause of circumstances then this should give a lot of hope to others who have not taken it further too. I know of a few cases on here whereby they have had to prove that they were not able to bring the complaint to them in time. Someone had to get something from a hospital to say they were doing daily visits to a dying relative they posted on here. FOS should open up these cases too and everyone else who has had the run around.0 -
Hi all,
Thanks as well Pinknico, we shall try.;)
We are hoping this will dealt with as a "brand new complaint" on the mis selling side of it and not the unfair rebate, with what we did originally try for with HFC, when hubby explained this to the guy yesterday he did say that should be fine, if HFC neglected this on the other, it may be worth a shot on the mis selling side of things as a brand new complaint, so see what they say on Monday.
We do have HFC correspondence in regards of unfair rebate but nothing about mis selling.
Yes I agree with that Marshallka, lots on here have had their own personal issues and what should go for one should go for another.
Good for urbangypsy on their's.:TThe one and only "Dizzy Di"0 -
Found the Endeavour personal finance letter/HFC
It's headed
Your complaint: Unfair Rebate.
It says that it was calculated using an industry standard method in banking known as "Rule of 78"
It also states that we have exhausted the Endeavour Personal Finance internal complaints procedure and no further correspondence will be entered into this matter.
Then confirms " It is important to clarify that whilst HFC Bank owns EPF, the products offered under each brand are different as such, are subject to differing arbitration services.

The address to HFC is slightly different to the Endeavour one that we originally wrote to but I expect they are the same at the end of the day.
The address sent by Hamilton by email to us the other day is
Central Complaints Team
HFC Bank
Camden House West
The Parade
Birmingham
B1 2XJ
And the Endeavour address we wrote to is the one in Winkfield.
But believe it was passed on to HFC though.
Just been having a rummage through the docs to see what I can find. The one and only "Dizzy Di"0
